I have a copy of the other drivers statement and in it he admits his intention was to carry on round the island to the next exit off.
his diagram and lane markings is totally incorrect in relation as to what is there in front of him.0 -
The problem with forums and what is written, is that posters can deliberately misinterpret,wordsmith or take out of context another view. The above is a good example, as are the funny diagrams.
I promise I'm going to stop but nobody is deliberately misinterpreting. We are just trying to show why what we say is more logical.
Straight on = pretty much straight on to leave the roundabout. (In this case then bear left after the exit once you hit the A38)
Right = Continue to bear right around the roundabout to another exit. (Until you find the straight on that allows you to leave in the right lane)
This interpretation allows you to do the things you need to do - leave the roundabout and continue round.
Your idea:
Straight on = bear right continue round roundabout
right = bear right continue round roundabout or actually turn right?
They're not actually telling you anything sensible if that's how you choose to interpret, hence you think everyone is in the wrong lane and it's everyone's fault because the markings are confusing. No one is saying that you are saying that you can't exit the roundabout. But why would the markings of a roundabout not in theory allow you to leave left but allow you to carry on infinitely right? What's the point in any markings at all?
The road marking are only apparantly confusing or misleading to you because you're misinterpreting them.
We all now need a statement from Worcestershire Highways on the right turn, left turn, carry on round argument. Suggests the court might as well!Everything that is supposed to be in heaven is already here on earth.

No sorry, none of what you have attributed above to me is what I said or intended. You can clearly exit left and cannot turn right off this island.
What I am concerned for the OP's case is from the middle lane with a vehicle on his inside,travelling at the same speed over this short distance is how he didn't see him as he exited the roundabout.He knew he was there at the lights and was even worried about his erratic driving. They must have been travelling side by side after leaving from a stationary start at the lights.0 -

I think I can see BF's reasoning although the car in the left lane should have turned left. An independent person looking at it as a one off may consider the contributory actions of the OP.
Given that the OP expressed his concern over the other drivers driving skills. I being in the same position would have tucked in behind on the left lane waited till after the exit and then overtook the other car. Or as transpired just turned left as the other car went straight on!
I do believe the major fault is with the vehicle in the left lane, but I do think there may be consideration of contributory actions. Hopefully for the OP not a lot though.0 -
I've been on that section myself and I have to say i'd never take the middle lane to go left simply because i've seen people do what the 3rd party did in this case.

Another view from the middle lane at the point where you would have to move left to take the exit off the A491 (the roundabout) into the outside lane of the A38N.
It looks like this last view reflects the current road markings.0 -

nope the markings are still as they are at the time of the accident, google images is out of date.
as you are sat at the lights in the left handor indeed the middle lane looking straigh on is the exit onto the a38 norht, this road then veers round to the left.
i was looking in my mirrors and indicating to show my intentions to turn left and i really couldnt see the other car , look at the angle he hit me at, any further round and he would of t- boned me. my guess is that he did start to turn down the a38n , realised this wasnt the exit he needed and then swung back out and caught me.
also at this part of the isl;and you are still on the a38 too not the a4910
