I won't be using my Asda credit card or shopping in Asda again.

I don't fully understand the concept of defamation of character, but believe it to be that if someone passes incorrect information to a third party which then results in another party refusing me the best mortgage deal because of my reputation due to the incorrect information, then this would be defamation of character.

This incorrect information is: "you have incurred default sums on your account with us" as I made a payment for the full amount on the due date by direct debit from my current account and it is recorded on the credit card statement as being credited on this due date.

The third party is the credit reference agency which then process this information and pass on destroying my reputation of a good credit history.

Wow - that seems somewhat tenuous. Check your credit record first. If there's a problem, then try their official lines of communication. If that fails, then try the ombudsman. If that too fails, then consider suing them - still not sure how far you'd get with that though...

You need to follow the procedures that are in place first - rather than just throwing your toys out of the pram for what is a very trivial situation which was, most likely, caused by an administration error and something which you could probably get rectified with a 30 second phone conversation!

OP, if you search this board over the last couple of weeks or so you'll find that Santander (who run your Asda card) have had a problem whereby they're incorrectly applying £12 fees even though the payments have been received on time by DD.

So, absolutely nothing to do with Asda! What more could they have done? You took the item back and they credited your card account the very same day.

A case of mistaken identity? (And also of your not being familiar with your card's T&Cs of use!)

Have you actually spoken to anyone about this yet ? If I were in your position, I'd be approaching them first to politely point out that they appear to have made a mistake in charging and asking them to correct it immediately, before going in with all guns blazing if they don't....

Well I've done the deed, cut up their card, written a letter and invoiced them in accordance with their terms and conditions.

Administration fee for returned items: £12.00
Over limit fee: £12.00 (as I was informed by Asda that £7 had been credited to my account when I returned the item, thereby exceeding the limit required by £7.00)
Cash transactions: 25.249% (Yes, I know it's £1.75 per year, but it's their rate and it'll probably go on for years).
Defamation of character: £negotiable (Depends whether they are prepared to repair my credit rating after ruining it).

I'm a bit confused. Your first message suggested the only item that appeared on your Asda credit card statement was £7 for the rice cooker. Now you mention something about going over your credit limit.

Anyway, things go wrong and mistakes happen. I'm sure a phone call, or even better a letter, to the folk who administer Asda credit cards would sort this problem out.

Calm down, pop another happy pill or a have a small Vodka and Cola. Works for me. :j

It's not particularly obvious, but I think the overlimit fee the OP was referring to is what they are trying to claim for their account being in credit - in the letter they have written to Asda/whoever. The OP doesn't say that they have incurred an overlimit fee.

OP - just talk to the provider first. They'll issue a refund for the amount you are in credit. Or, just spend it! Really are making a mountain out of a molehill.

For the sake of £7 pay cash next time as its embarrassing to pay such a low amount on a CC.

I put £4 onto my MBNA card in Waitrose today. When contactless payment rolls out, I'll put 10p onto it!
