Do the council have a legan responsibility to move us?

  • If you're with "Choose and move", I presume you must be under Kirklees Council. A quick look at their website shows that they frequently let properties to those in the lower bandings, even band D. So, if the need is so urgent that you are prepared to be flexible, then you need to start effectively bidding in such a way that YOUR actions reflect the urgency of a move. It is very unlikely that they will give you a priority for ASB unless there is a quantifiable and serious risk. At the end of the day, they will concentrate on resolving the ASB, and YOU have a part to play in that as indicated in earlier posts. Unless they resolve the ASB then there is every likelyhood that the next tenants in your property will suffer the same fate.

    We can't log in yet! no details but you can view the choose and move. Problem is a 3 bed home is rare, and one in the village we want could take months and months.

    We have tried to help the area. So many times and none of it any good. If the police do catch them the courts let them go. If they catch one there are 15 more to back their friend up.

    The only chance is if they were all gone in one sweep and people got used to a normal life. Then if they came back hopefully people would speak up, but at the end of the day we have been here 8 years, and it's not got better, just worse.

    Tomitma, thank you for your post and i'm happy to see that you have moved on. I can't say my situation is as bad as yours were but wouldn't say it's not heading that way! I hope you are now happy where you live.

    Yes we are happy now, we are on a private estate, 60 miles away from my family, we had to move this far, because I didn't feel safe staying in the same town.

    Go for any house that you can find, don't care if it is only a 2 bedroom, you have to think of your own safety. If you do get a 2 bedroom, you can always go for a 3 later, or save the money for a deposit to rent a 3 bedroom privately.

    On the day we left our house, we lost everything, the police turned up and all we could take was what we could get into the van, our car had been petrol bombed just 2 days before. Within hours that house had been trashed, paint, !!!!!!, they just took the furniture that they could sell, and set fire to the rest in the garden. I broke my heart, but at least we are now living in peace and tranquility, and we still have each other. We have lovely neighbours, I often forget to lock the front door, or my car, but no one would dream of nicking any thing from you here. I miss popping around to see my Mum or Sisters, but that is a price I have to pay. Do anything but get your selves out of there.

    As recently as this month, a 4 bed in Huddersfield was let to a band D applicant who had been on the waiting list for less than 2 years, and in September, a 3 bed in Heckmondwike was let to a band D bidder who joined the waiting list THIS YEAR!!!

    If you DO need to move urgently, then YOU need to get your housing application sorted so you can bid and not be so fussy. Quick, cheap, fast.... you can only have 2 of those options.

    Kirklees (like many councils) publish succesful bids on their website. Always the first place to look if you want to know what is available and when. I only looked at 3 and 4 beds, but there are plenty of 2 beds going to band D applicants as well, if you are prepared to downsize. Must admit, I'm surprised that you have left it so long to even apply for re-housing.

    Just get anything that you can, once you are out, then you can think about what you want to do next, the feeling of relief that we have now, last year at this time, over Halloween and Bonfire night, we had people letting of fireworks, so that they would hit our car or windows, they put fire works through the letter box, cut our phone wires, it was hell.

    This year not one fire work was let off in this vicinity, no trick or treaters, no rocks through the window. Just take anything that you can. Then get the money to rent if you have too.

    Like Tomitma says, we were stubbon and didn't want to be run out of our home. There are quiet times and times when it's bad, but this obviously crosses the line. Although we've had trouble before it was random. This time they specifically targetted us for a reason.

    I've told my mum if it comes to it to get a two bed with my little sister and i will find somewhere to live. Just don't want to split from my family if i don't have to just yet, as well as the 'why the hell should a be run out of my home (which i agree i need to leave) and lose my family to! But there safety is far more important, i understand that and when it comes to making that choice it will be easy. I just don't want to be put in the posistion where we have to split up to be safe. We shouldn't have to.

    What a horrible way to have to live amongst thugs who treat other human beings in the way you and others have described. What a dreadful indictment of this country in this day and age. All these people who go on about being denied their human rights.... while you're having to live in this hell.

    Someone referred to the Pilkington case. It's a farce to hold an inquest if nothing ever changes as a result. Yes, see your MP - they will hold a surgery somewhere locally, where you can talk to them.     I hope you get a proper response and a move to a safe place to live as soon as possible. May you find the peace of mind and life you are entitled to be able to live.
  • The little housing man came round yesterday, and to cut a long story short.

    We have to prove we are in danger. He has to refer us to the 'housing option' people, who want evidence (which i have to provide) in order to discuss it at a panel meeting and decide our fate.

    Since "it's only damage on property", he basically said we would have to be physically attacked before we would be classified 'at risk'.

    (this took over an hour to get out of him as he does well at avoiding questions).

    He kept mentioning the bond scheme (council pay the bond for a privat rented home). And as i explained 3/4 times, thats fine, but are you also going to provide the £300 difference between what we pay the council and what a private landlord would charge monthly as well. (answer obviously no)

    Apparentally we cannot attend these 'panel meetings' (nor does he) but just gives them a bundle of evidence.

    So, pretty stuffed. What kind of evidence they want is beyond me. The problem is, WE feel unsafe in our home but have to prove that to a panel of people we don't know, without being there, who want evidence.

    Any idea's?
