Have you requested a copy / transcript of the call (And the rest of your file) under a Subject Access Report ?
I think you'll need to send this by post (signed for) rather than asking on the telephone / e-mail, and I think you have to send some money as well at the same time - £10? But others will confirm that.
Considering the large sum involved you need to be as organised as you can be. Do it by the book and good luck.0 -

MAX charge for a SAR is £10.
I did one with Npower and never go charged, so that is the max there are allowed to charged, not a set fee.0 -
Have recently returned from holiday and whilst abroad i had to have an emergency operation, i have now been slapped with a hospital bill of 14,000 euros and the insurance company are refusing to pay as they say it was a pre-existing medical condition. it wasn't as although i had had some problems before going away i had not had a definite diagnosis by either the hospital or GP. Can anyone help!
Did you not have an EHIC (European Health Insurance Card)?
Most insurance companies usually want to know if you have any health problems, if you have seen a doctor or the hospital and then will not pay out for any of these conditions/problems even if they were only under investigation. I doubt you can claim anything back now under the EHIC scheme but worth asking the question anyway.Everything has its beauty but not everyone sees it.0 -
yes, i requested this in a phonecall and also in my letter i said if the decision wasnt in my favour to send me copies of everything, they have now written to say its not in my favour but have not sent me copies of anything!

I think you should get your MP involved in this. Get them to write to the CEO of AXA asking for an explanation of the conduct of their company.
The people dealing with the claim appear to have made up their minds that they are not paying or willing to release information e.g. call recordings/transcripts to help you. You therefore need to elevate your complaint, otherwise you risk being mucked around for months.The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.0 -

EHIC was irrelevant - even though we did have them as you will see in my original post unbeknown to me at the time i was whipped off to a private hospital to icu - i didnt even know where i was!0 -

You are right, but i am slowly losing the will to live with all this, since having the op i have been left with complications and just dont know how much more fight i have left in me - im normally a little fighter but even i'm starting to think i can't win this one. it would appear it hinged on the Dr notes - or thats what they are using as a get out!0 -
Foreget the Drs Notes for now - you need the transcript of the conversation where you informed the insurance co and was told you were covered. You need to follow the process, get the documents, go through the complaint process and go to the ombudsman if need be.

You don't want to give up. I have used my local MP on an occasion and they wrote on my behalf. It can be quite surprising how quickly companies react after getting a letter from an MP.The comments I post are personal opinion. Thought i would give you chaps an update, i have had a phone call from the financial ombudsman who say they are upholding my complaint, so as long as axa don't go to appeal things should be ok (fingers crossed)0

That's great news Nick, it would be interesting for us Insurance bods and also helpful to any future viewers of this thread who possibly could be in a similar situation with Axa if you could post the Ombudsman's reasoning when you receive it.0
