    It's very common in certain countries for hotels and / or reps to receive a kick back for sending guests to a particular private hospital.

    You need Axa to release their file on you including the telephone call, you are entitled to this under the data protection act and it could help massively with your claim if you can prove you declared the matter to them and they accepted it

    When did you book your holiday, what date did you take out insurance, what date did the you see the doctor and what date did you travel
  • Holiday was booked in January 2010, insurance is automatically there with bank account so we have had it years, saw Dr (GP) early October and travelled on 13/10/10.
    what are you thinking?

    You need to discuss this with the GP. Can the GP send Axa a letter explaining the position ? Would this help your cause that the enquiry you made with the GP had nothing to do with the problem you had while abroad?

    In the policy you have, what does it tell you about what you must disclose and when you have disclose it. Which bank are you with and what account type e.g advantage, premier? We might be able to look at the policy wording online if it is online. Dacouch has recently posted some information from the FOS, which might help with this situation.

    Appears EHIC may not cover, unless the hospital forms part of Cyprus state health care system. Need to enquire whether this hospital is part of the state health care system. In some countries private hospitals do provide for the state system. Worth enquiring.

    In regard to looking at the Insurers paying. You need to.

    1) Discuss this with your GP. See whether they can help
    2) Look at disclosure requirements of the policy. Did you fulfill these when you made the phone calls.
    3) Obtain all information from AXA under a Data Protection subject access request, including the phone calls that you had with them. Do this as part of an official complaint in writing to them by recorded delivery.

    Will have to check this, i'm not entirely convinced i have any paperwork as such

    Upon doing some checking, the hospital is totally private!
    Axa in athens were supposed to be ringing me yesterday but as with all these places they didn't bother - looks like i will be playing chase again today trying to find out who is dealing with it all.

    You really do need to either get hold of the wording or let people know who the policy is with.

    Whilst I have sympathy for your situation, as the insured you are responsible for ensuring that you comply with the policy terms and conditions and don't just assume that the policy will respond to a claim.

    Please try and provide the info for the experts to have a look at - you will have a document somewhere even if is just referred to in correspondence from your bank. We were with HSBC premier and the wording for the travel formed part of the information that we were sent with the general account info (although this was a while back and may have changed). If you are on online banking you also need to have a look at any changes to terms and conditions the bank may have advised you of online. They have a duty to do this, but you have to read what they say.
