Not entirely unrelated but as you and a few others on here seem to know what you are talking about maybe you could help me.

My wife ordered 3 mattresses off of ebay, unfortunately one of them is the wrong size (ordered incorrectly not sent incorrectly). Before I had even arrived home she had the plastic off! So I thought there was nothing we could do but reading through this thread can we send it back for a refund? (7 days up tomorrow).

I suggest you start a new thread as you may get bogged down with the OPs problem and it makes the thread awkward to follow..

Re 7 days, when did you receive mattress? don't forget the 7 WORKING days start with the day following delivery.

    Hi,
Can I also suggest you start a new thread. This thread is about a genuine request for a refund under DSRs with the seller paying cost of return due to fact that they advised a product which was found to be unsuitable. Your question seems to imply you made a mistake and are looking to take advantage of consumer protection laws to get a refund - two completely different things.

His was a genuine request for a refund under the terms of the DSRs. He's not taking advantage of anything he simply wants to exercise his statutory rights, just like you. :naughty:

    Very nice thank you!

I will start a new thread as advised but I agree with Neilmcl :).

Thank you didn't know that. Received Saturday IIRC. Will start new thread as advised.

I thought he said he ordered the wrong size? Maybe I misunderstood. I apologise to the poster if this is the case :embarasse.

Surely DSRs are to give you the opportunity to examine a product and reject it if it doesn't meet your requirements? Rejecting because you ordered the wrong size is unfair on the seller? Having said that - Legally it is correct!

Distance Selling Regulations are there in case you change your mind. The reason is irrelevant.

Libel, slander and blackmail quite a selection there. I hope he has deep pockets.

For what it is worth there is growing legal opinion that what is stated on chat rooms is more akin to slander than libel.

My advice for him would be to think very hard about it.

Thanks for the post but I' not worried as I think he would be a fool to try to sue for libel when someone is telling the truth!

I think the suggestion of bullying tactics were spot on

    True. I stand corrected.

Retailers probably already allow for this in their margins anyway so no point in feeling sorry for them - especially after what I've been through.

Have answered you on your thread, sorry it's so late, I've only just come back from xmas food shopping in France! :o

However, as someone else has already said, and I had mentioned higher up, it's 7 working days starting the day after you received the goods, so total of 10 days.
