ESA stopped... What do we do now?

  • Sorry if anything I am going to say has already been said.

    The same thing happened to husband. He claimed ESA and same as your daughter was meant to attend a medical but didn't get the letter, however did get the form asking him why he didnt attend. This was filled in and returned but his money was still stopped.

    He took it to appeal and was turned down as they said that it wasn't a "reason" but an "excuse"...not sure if I know the difference. They said that as all previous letters had been delivered successfully that the had to assume this one had too....although we have had previous payments not turn up and informed them of this.

    He was not able to claim ESA for 6 months as a sanction,l but could claim JSA...I thought it was called Without Predjiuce, but I see someone on here said it wasn't. But basically meant he had to sign on once a fortnight although not look for work.

    He is now fit for work again and claiming JSA. It is a long slog to get to an appeals but it doesn't cost nothing apart from time so go for it.

    It is obvious to me that the postings of the new member named walking stick are abusive and I believe are just provoking and troublesome and should be deleted. Dianne

    Any reason for the "new member" comment? Abusive? Try truthful. I think it should remain up to the moderators wether a post is judged to be abusive.

    Believe me raising an MP query can work wonders. I worked in civil service and everytime we got an MP query heaven and earth was moved to get it sorted.

    Did you appeal and if you did don't forget to request a statement of reasons as to why you were turned down . Put it all together and take it to the CAB and it's not the first time an MP got a decision re visited. Fight your corner !!

    Just wanted to update for all the genuine people who have given me good advice.

    We went to the tribunal this week and the appeal was allowed, so her benefits are to be reinstated and backdated too.

    The tribunal heard from my daughter, and accepted that the appointment letter had never arrived, they were very understanding and could see she was in a state (it was touch and go if she could attend).

    We are thrilled.... she has now been referred to a psychiatrist, by her GP, and are hoping she can get well again. As i have already said, this is no way for a 25 year old to live.

    Of course, none of this needed to have happened but for certain politicians paying heed to the daft babblings of a former banker who now claims to be an expert on "welfare reform".
