ESA stopped... What do we do now?

    Thank you so much for saying that, we do our best, before this came on, she worked full time and was enjoying her life - as you should when young and with no responsibilities.
    She had a job even when she was at school, and then worked full time right upto becoming ill. I am sure in time she will get well again and get her life back.

    Thank you that is really good to know, I will try to get her to see her GP (that will be tough, she will only see one Dr and it is such an ordeal).

    To be honest i dont know if that would be allowed? The current sick note she has doesnt run out until 15 Jan 11.
  • I sent off the letter off yesterday and have a copy and proof of posting etc - so will have to wait and see what happens next.

    It is so frustrating dealing with these people, i tried 4 times yesterday to speak to somone in Jobcentre who could help me, got nowhere as the number was not accepting any more calls as they were so busy!!!!!!!!

    Yesterday my daughter recieved a reply thanking her for her letter, they are going to look again at the decision and see if they can change it and reinstate her ESA, if they do, then the appeal will automatically be cancelled. If they cant change the decision then the appeal will proceed.

    So i suppose at least they have replied quickly, we will have to see how long it will take them now to make their decision..... of course my daughter is still not recieving any money at all to live on.

    Once benefits are re-instated, then she'll get them backdated - but I know that that's scant consolation for the time being.

    As far as an appeal goes, it can still proceed if they decide to re-instate ESA - it doesn't automatically cancel just because of a re-instatement.

    ESA will continue to be paid at assessment rate until a final appeal decision is reached.

    If it was the DWP who told you that, then remember that every time you phone the DWP, and ask the same question, then someone else will tell you something different to the last person you spoke to.

    The only kind of consistency that the DWP are known for is being consistently stupid. In fact, I don't think that DWP staff members actually know what the hell they're doing.

    Something to bear in mind for the future - the next time a medical is booked for her, and if it takes place, it's worth covertly recording it.

    It's not illegal to do so, and it'll make her case for appeal much stronger if there are lies or inaccuracies on the report.

    this is a standard letter that they send out when you fail the medical, it must be the same for appealing against a missed medical etc.

    FTW you have the wrong end of the stick, the appeal isnt against failing the medical but for not having got the medical appointment so if the appeal wins there is nothing left to continue to appeal against for now, maybe reading the thread is a good idea instead of just posting your own bile against the DWP after just seeing the initials ESA.

    And at what point did I say it was against failing the medical?

    It appears you haven't properly read my response before chipping in with your own bile.
