ESA stopped... What do we do now?

    Is it possible that the benefit was stopped because your daughter "didn't attend" a medical and then failed to submit a sick note on time?

    I realise that she never received an appointment for the medical but it does look rather suspicious that in September the claimant said they never got an appointment for a medical and in October/November they fail to submit a sick line.

    Your daughters failure to submit a line has compounded the original problem, why couldn't another doctor have written her a line when her benefits claim was depending on it? At our surgery you can call in to request a sick line if you've seen a doctor recently about your condition, could you look into wether your practice offers this for any future lines where the prefered GP isn't available?

    She has asked in the past for a sick note, as when it is obvious they will be re-issuing another note, it seems a bit of a waste of a GP appointment. But her GP said he does like to see her himself, and with the illness she has, it is difficult enough managing to get to the Dr's in the first place, without the added stress of explaining yourself to a different doctor.
  • Well after all those weeks waiting.... she rang the ESA department only to be told the decision maker has REFUSED to change the decision.

    I just dont know what to do next....... I am thinking that the appeal is still going to be going through (as i noted in the letter to treat as an appeal if the decision was not changed). I am considering contacting my local MP, not sure how to do this, especially at this time of year, and even what if anything he could do to help us. She has been without any money now for months, and was told the appeal could take another 6 months.

    The woman from ESA, told my daughter to sign on for JSA, but how can she, she had to come off JSA because she was unable to get there to sign on, never mind do a job, she had no income at first as we didnt know about ESA for a few weeks, but she just couldnt attend the jobcentre.

    Any suggestions please, as I am desperate to know what to do next to get some help....

    She should be claiming the ESA assessment rate whilst she appeals. She needs to tell them this, it is not done automatically.

    No point in contacting your MP once they have reconsidered, it won't get her moved up the Tribunal waitlist any quicker.

    So if she contacts them and asks to claim the assessment rate, do you think that will be accepted? - i think she was only on the assessment rate anyway, as she has not yet had a medical.

    The person she spoke to today never suggested this as an option, she only said go on JSA, or claim crisis loans, it seemed that she was making these suggestions in good faith, as she could tell how upset my daughter was.

    Thank you for your advice.... we just dont know where to turn.
  • Are people really trying to claim esa on medical grounds for depression & anxiety oh I nearly forgot she also gets the squits!! No wonder they want to look into this case. There is nothing stopping me going to my gp and claim I have depression mention the "key words and phrases" and get a sick note then expect the state to fund me. No wonder the goverment wants to examine peoples claims.
    Yup I know its not being very sympathetic but ho hum this is a reality.

    Sadly i am going to have to leave this thread now, as i am not prepared to read post like the previous 2, the latter who has obviously not even bothered to read the full thread - or cant understand the written word.

    I came here and asked for help, and i would like to thank the many genuine people who have offered us advice. I will look at other sites for continued support.

  • Unfortunately, I have heard of this happening a couple of times. I have a friend who is in exactly the same position as your daughter.
    Have you thought about going to see your MP at the next surgery and getting them involved?

    I just think nothing ventured nothing gained. My MP is supporting me in going to DLA Tribunal as she thinks the wrong decision has been made.
