  • can anyone tell me if I am entitled to the CWP I am in the procees of an appeal agaist my benifits being stopped and am recieving a reduced rate of income support and worse off. I got it last year when I was on a disability premium. Any information would be a help

    if not getting disability premium ie failed a medical and are on reduced income support because of this then no you wont get cwps

    I'm also going through a tribunal, it's been going on for months and still have to wait another 4 - 6 weeks lol.

    However I'm STILL getting ESA but a lower rate as I'm still having to send sick notes in. It would be like when you first go onto ESA when you get the lower rate of £65. So he might be going through a tribunal but is he still sending sicknotes in?? I've also have a claim on hold for ESA pending on the outcome of my tribunal, something my solicitor advised me to do.

    So should I still get the CWP's?

    Ah, think we have worked out why I am not appearing on the scans...they have inputted my youngest son's date of birth wrong!

    Really weird, all the boys DOB's are checked at each WFI, at the start of the claim, all birth certificates were produced etc but they had his birthday as 2 days before....the advisor thinks someone at the beginning of the claim hit the 3 instead of the 5 and as they use a different system (or something), that is the reason it has not been picked up. It is something as simple as that which can mean the scans would not include our details.

    She is now going to check further and hopefully get my payments out in the next few days.

    Goodness only knows why someone didn't pick up on that last winter when I spoke to them several times about the payments....but it wasn't.
    We made it! All three boys have graduated, it's been hard work but it shows there is a possibility of a chance of normal (ish) life after a diagnosis (or two) of ASD. It's not been the easiest route but I am so glad I ignored everything and everyone and did my own therapies with them.
    Eldests' EDS diagnosis 4.5.10, mine 13.1.11 eekk - now having fun and games as a wheelchair user.
  • Hi i was wondering if anyone knows if i should be entitled to cold weather payments i know that 4 have been triggered in my area, i recieve ESA and am placed in the work related activity group from what i am reading online i believe i should be entitled to them i contact jobcentre plus 2 weeks ago to query this but have had no answer i would have thought they should have been able to tell me more or less if i am entitled.

    if you win your appeal and are on income based esa they will owe you for the cwps in your back pay you cant get them on the assessment rate

    if you get income based esa you should get them if contribution based you wont
