Hi, i recieved the same letter today, have phoned abbey, and they said that they were entitled to reclaim the money from me! I did manage to find a telephone number for BACS,who run the direct debit scheme, and they said that that once a customer has been refunded under the direct debit indeminity the bank cannot claim the money back (try telling abbey that)

will complain in writing to abbey,in the meantime I will be closing my account, because like you I cannot afford to repay this money.

I have sought professional help with this so just seeing what will happen. I told them to shut my account down already but they said the money would still have to be paid even through court.
Do you still have the phone number you rang please for bacs info?

Hi,I'm going to ring bacs tomorrow and see if the can email me a copy of their code of practice /rules (tel 020 77 11 6370)
from what i understand, under the DD guarentee, abbey should in fact be claiming direct from the third party (farepak) not the recieving bank (barclays) as stated in their letter that they sent,so if nothing else they are not following the correct procedure! so if they do insist on taking people to court it wont look favorable on abbey if the haven't in fact done this.Fingers crossed that I can get hold of something that confirms this.

I will post tomorrow and let you know if i have any luck with bacs.
  • I think this is a really disgusting move by Abbey...

Talk about chasing after the little people. So people/agensts that have lost money already, will have shared this refund out, to customers who lost money, and the original bank account holders are now expected to find money from somewhere to pay Abbey back -- totally and utterly ridiculous!!!

Well done....What day have they said they are taking yr money back? Mine is 1st Feb..
I contacted financial ombudsman who said they are a last resort for complaints but you have to allow 8weeks for bank to deal with matter 1st.
This had made me unwell this week and just want it over with....I've put on another site that if the money does leave my account I will not hesitate to take this to the press, will you be with me?
Hope there is something good to read on here later....

  • Good news we won't be having the money taken after all, Just had a phonecall saying the payment should never have been made in the 1st place but that was their error..... There are 19 ppl in total that this happened too.
