Preliminary Hearing Regarding Bank Charges Claim - Advice Please.

I quite agree with you, that it is going to be a waste of time as you said, but at least we are in the system for the outcome whenever that will be.
My claim is for £3765.00 so will keep on fighting, and everyone else who is reading this should do the same.
I do have doubts though. when high courts throw out really serious things for example the simple low cost of the alzeimer drug at £2.50 for the suffering.

has anyone got any advice for me, I am due in court tomorrow to reclaim charges from HSBC, they have applyed for a stay but i have spoke to the court and they still say i need to attend , its only a preliminary hearing (10 mins) havent a clue what to take or say, never been court before. PLEASE HELP
Have a look at the threads on arguments against a stay it is not certain that a stay will definitely granted but if you go and are fully prepared if the bank do not turn up you might get judgment in your favour. Also if you are prepared you might convince the judge not to impose a stay.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -
I'm going to court on 24th against HSBC, they applied for a stay but my local court tells me to turn up anyway.
However no-where does it say about sending a court bundle to the court or to HSBC, not on any letter I have had. So many people on here are saying you need to send on 14 days before the court hearing.
I'm going to get together all my statements and letters for the day, but is there anything else I need to take with me?
Its only for £400 or so, I sometimes wish I hadn't botherd with all this.
Please help, I am so nervous about this, I can't sleep at night.:o0 -
hey, there im in the same boat, going to court tomorrow so ii will let you know how i get on, i have not had to submit a bundle but just taking the relevent docs with me as you are. my case is for about 600 it will probably just be put on hold until the test case is over, DG have wrote to me to say they are applying for a stay but the court have not yet responded, I was worried about it too but whats the worst that can happen, its only a small claim0

There are a couple of threads here which have arguments that you can use against a stay being imposed. If this is only an application for a stay then you do not need to bring a bundle. Make sure that you know what you are going to say. From some of the posts it is not clear whether the judge will actually listen some do some do not.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -
p.s its just a prelimary hearing which is why you dont nesesarily need a bundle, this wont be stated on your letter, just says the hearing date0

If the bank don't turn up to argue for a stay the judge may well award in your favour so please read what you can and be prepared to "plead" your case.
