Preliminary Hearing Regarding Bank Charges Claim - Advice Please.

    I have also got the same date and time to appear in Peterborough County Court. It would appear that most banks do not send someone to these hearings and the judge rules in the claiments favour. Not sure what to take either but hopefully someone will post some advice. I don't think you should worry, you have done nothing wrong and they have already taken your money so they can't take anything else.!!

    See you there, unless the bank settles before hand.
  • I've been ordered to attend the hearing on the 25th June. It says the case has been listed with other cases on the same occasion because it appears that the main issues involved in all the of them are the same or similar.

    It also says there will be no final hearing on that date so the court will not hear from any witnesses as to the facts on the cases of that occasion. The court will be giving directions for final hearings.

    What on earth does that mean and what is this stuff I have read about Court Bundles? There is no mention of that on this letter.

    Am really getting scared now - someone help!!!! :eek:

    I have had a letter from my local court saying I have a DIRECTION HEARING to attend, soon.

    They say 5 minutes have been allowed for this.

    Do you know what this is?:confused:

    My first flippant reply would be when you turn your head... :P

    But seriously it's when all parties discuss the directions the judge should be making to the other side. In the CAG site court bundle template there is a template for draft directions.
    Hamsters have no tact and diplomacy, nor do they want any.

    Directions hearings are good. At the moment the banks have not found a way to deal with these as they will not turn up so agree to settle before it.

    take Kurt_Ham,ster's advice and get the draft directions. Be prepared as if it will go ahead so that you do not get a nasty surprise if they manage a way to try and get a judge to listen to them without turning up.

    It would be interesting to see if there is anything on your order to say that you could file written submissions only.

    Hi

    I just rang the court to chase up my claim and they informed me of a 10 min "directional" hearing on the 17th July.

    Does this sound right?

    When do (if!!) the banks decide to settle last min. Usually once they recieve the court date themsleves?

  • Today I've received "Notice of Allocation to the Small Claims Track" (preliminary hearing)

    "District Judge ***** has considered the statements of case and allocation questionnaires filed and allocated the claim to the small claims track.

    Before the claim is listed for hearng, the judge has ordered that a preliminary hearing should take place because special directions are needed in this claim to prepare for the final hearing which the judge would prefer to explain to you in person

    The prelim hearing will take place on 31st may at*******"

    WHAT DO I DO? I never got an AQ (it was dispensed with) , I haven't got my court bundle, prelim hearing what and why? I'm really panicing, if nowt else I can't get that day off work I know for sure

    I have had a letter from the court and unsure what it means. I can't work out if it is the hearing, a general chit chat or what, and if I need to go to the court or not. The details are as follows:
    General Form of Judgement or Order

    To the claimant

    Before DISTRICT JUDGE HENDICOTT sitting at the Cardiff County Court, Cardiff Civil Justice Centre, 2 Park Street, Cardiff, CF10 1ET.

    Upon neither party attending

    IT IS ORDERED THAT

    1. Directions will be given in this case by the Designated Civil Judge, His Honour Judge G H Hickinbottom, on [time and date in August] at Cardiff Civil Justice Centre, 2 Park Street, Cardiff CF10 1ET.

    2. The parties may appear in person or make written representations as to how the case should proceed provided a copy of the representations is sent to the Court and the other side at least 7 working days prior to the hearing.

    Dated 28th June 2007.

    In case it is relevant, I received a Notice of Transfer of Proceedings issued on 24th June 2007, and the bit which said I had to return an allocation questionaire has been crossed out.

    Any help and advice would be greatly appreciated!
