Just had a court date for a Preliminary hearing for the 5th Sept regarding a barclays bank claim. It was sent pre this new ruling as its dated 24th July.
My Questions are
a) Is this still valid or will i recieve another suspending it?
b) If suspended can i claim the £120 back for opening the case?
c) If it still stands, i have to turn up im assuming i have to bring all relevant details regarding communication between me+bank as regards to trying to resolve this dispute?
d) Its the first time ive been involved in the judicial system so am unaware as what to say or what will be expected from me when im there.
e) Any other advise would be greatly appreciated as this is were im kinda getting nervous.0 -
You are right on a and c unless the court advises otherwise before then you should turn up and present your case.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0

Hi all,
Plz can some one help... Iv been chasing Abbey for a claim of over £1800, filed small claims on line, no defence was put forward infact it wasn't even acknowledged so filed for judgement / default by decree. But now iv received a date for a court hearing for 16th August, but i never received no AQ or anything that everyone here mentions, phoned the courts and their words were 'i don't know were your getting this info from but we don't use things like that??????' I then asked about the court bundle, wat exactly they would like me to send and will i forward copies to Abbey as well... 'Again i don't know wat your talking about?????' 'Just send a copy of your statements and your reference number'???????????????????????
What?? Is this really the way it goes? I know its northern ireland but id have thought it wouldn't have made such a difference as to the courts not knowing what im on about?!?!?!
The only thing the court letter said was the date of the hearing and that i the claimant had to be there, but the defendant didn't, they just had to let me know either way??
Am i completely stupid and over-reacting or am i just simple?
Plz plz can someone tell me wat to do now? I know iv to send copies of the statements and charges and any correspondance into the courts but wat all exactly?
PS im hoping this makes sense!!0 -
Hi Guy's
This is my very first posting so if I mess up, ..very sorry!
Just wondering if anyones been in the same postion as me and what happened to them.
Am trying to claim £115 from LloydsTSB, who are taking me all the way to the county court. Was awaiting a hearing date but have just received a letter on the 24 July stating that I need to go for a preliminary hearing which the judge would prefer to explain to me in person as, letter says: 'special directions are needed in this claim to prepare for the final hearing which the judge would prefer to explain to you in person'.
Do anyone have any idea why this is happening?
Some of my friends have been sucessful in claiming back thousands of pounds but I'm going all the way to court for just over a hundred quid and to be honest I'm beginning to wonder whether it's worth the sleepless nights I'm having.
If anyone's gone any advise, please, I would be so grateful.

Sounds like a Directions Hearing rather than a full hearing of your case if the defendant doesn't need to attend. Have a read of the previous posts.0 -
Hi all,
I have a preliminary court date on the 17th, taking HSBC to court over the sum of £3115. With the OFT case, is there any point me actually going? I haven't heard a murmour from the court if it's been stayed or not...
Assuming it goes ahead, what exactly should I bring? I've heard people discuss their "bundles" wwhere do I find more info on them??
Thanks0
