I feel really sorry for the son in all this, it can't be good for him all this messing about. I think the school league tables aren't all that, if he's intelligent he will do well in exams, if he's thick, he won't. I think personally the judge will side with the mother, and you will see him at weekends.
If you allow this residency thing to take over your life when are you actually going to enjoy seeing your son grow up?0 -

I was enjoying seeing my son grow up i cherish every minute of life being with him, i really hope you never have to experience what is happening in my life and my sons life!0 -

Just read bits and pieces of this thread. Sorry about the situation you are in, my partner went through something similar when his wife walked out with their 2 kids, One piece of advice i would give is that women (not all) are very good at manipulating and twisting things in a court. You really do have to appear whiter than white, dont put a foot out of line, get angry or shout because she most definataly will use this against you.0

Be completely straight with the Head & Deputy of the school you want your lad to go to & with the nurseries - and try to get them to document that you have had these discussions - email them notes after & aske them to sign if they agree?
'Fraid the posters warning about behaving like a saint, never raising your voice or hand etc all hold true - the good old bad old double standards are still alive & well, so I really hope you have the backup.
Keep an eye on your employer - now would be a really bad time to loose your job. Whilst grousing is reasonable, keep an eye on where & when & for how long.
I am blown away by the effort you are putting into keeping a good relationship with your son - I really hope it works out for you.

Yes unfortunately I am back again, quick question guys if anyone can help, i have instructed my solicitor to raise a writ and i am seeking full residence of my son, as my ex has over stepped the mark, she was supposed to drop our son off at school on Monday morning but didn't and is not refusing me access to my son and is continuing to keep our son out of school, my question is how long can she keep him out of school or can she try and register him at a school closer to her, he has been living with me all this time, she had our son at weekends (nothing in black & white) just an agreement we had in place can anyone help?0

Sorry to hear things are not good.
What part of the country are you in? You need to find your local CME team, Children Missing Education and report him.
I think the next step is to get the solicitor to apply for a court order to have access in black and white.0 -

I am in scotland, and spoke with my solicitor yesterday and instructed him that i want to apply for full residency of my son so he has set in motion to serve a writ. I can't believe she thinks keeping our son out of school is in his best interests!!!0 -

or ring 0131 260 5352 - they can try to advice what next i think. In our area, they take a serious stance on CME and are very harsh.0 -
