I could have sworn that Muffinmaker simply stated that the item had been crossed out on the original receipt. There was nothing to state that "returned" or anything else had been written down.
Using the "logic" quoted above, I could get any old receipt, cross out an item and take anything back to the shop and demand a full refund
Now that is splitting hairs, normally when you return something the receipt is marked in some way, obviously we can't see that receipt but I feel that the OP wouldn't have started this thread if she was trying to con the shop.
Anyway you all keep up the tyrade on new people to the forum it's what you all do best.0 -
Sorry Muffinmaker, but this is what happens on MSE - people see that you haven't been on the site for very long and they just attack and criticise you.
I think you should write a letter of complaint if you feel strongly about it. It's true that your statutory rights don't entitle you to a refund because the item isn't faulty, but I can see why you feel hard done by, given that you had the receipt originally and the rudeness of the manager.
Is there possibly an argument that it isn't fit for purpose because it's too tight on the arms? Probably not because you had the chance to try it on, but something worth putting in your letter. You might as well send it to head office too.
:rotfl::rotfl::rotfl::rotfl::rotfl:!!!!!!
No No No OP is entitled to nothing nada zilch zero!
Lesson to learn keep receipts,do not remove tickets until you are sure.do not try to return things you have worn
Has made me laugh so much reading this thread thanks everyone :T"Very funny, Scotty. Now beam down my clothes."
All truth goes through three stages. First, it is ridiculed. Then, it is violently opposed. Finally, it is accepted as self-evident.0 -

No one has ganged up on the OP, the only thing that happened as that advice was given and it was over looked or the OP was so used to being refunded by other shops for stuff the OP got into a set routine.
why do people have to get upset by comments made by others whether true or not when they ar emade by people at other end of a computer0 -

The "fit for purpose" requirement doesn't work like that. "Fit for purpose" refers to the purpose that the product was designed or sold for. It doesn't refer to the purpose that the customer wants it to perform.
In other words, if you buy a pair of size nine shoes when you are a size ten, you can't claim that the items are "not fit for purpose" when they don't fit - because they are "fit for purpose" for somebody who is a size nine foot.Hi, we’ve had to remove your signature. OK so we are all agreed then River Island should give the OP a refund.0

I have taken items back to River Island (and other shops) before without a receipt so if I was you I would take the cardigan back to another branch - but they will most likely only swop it or give you vouchers. I have done this a fair few times with diff shops. I sometimes rip the tags off because I think it fits then when I actually go to wear it I change my mind - I have taken stuff back with the tags removed but actually take the tags with you. As long as you are polite it's worth a go.
Also shops do resell returns because I buy a lot online and my local River Island is small and doesn't stock the full range so when I take something back to the store I then see it on the rails the only one like it in a size 6 which they don't stock it's obviously the one i returned there.
And in response to the person who said it would have to be sold on ebay as used!! - that is rubbish just because something has been tried on doesn't make it used.
So my advice is try taking it back to another branch and if it's still a nono either keep or sell on ebay as new without tags - you will prob get nearly all your money back.0 -
Muffinmaker sure is one angry lady you dont want to meet up a dark alley !0

OOh, get you with all your exclamation marks!!!!!!!!!!
It is used, she has worn it so it's not brand new is it????????? If the arms are too snug she may've stretched them anyway.
ANYWAY, she said ebay is too much hassle (like all the fuss and bother with the shop and writing to head office isn't?) and she'll probably wear it anyway! SO why all the fuss in the first place? It's obviously not too uncomfortable to wear.
GET OVER YOURSELF!!!!!!!!!!!!!!! AND ONE FOR LUCK!:rotfl:0
