River Island refusing to refund even with a receipt!

She has the tags and she has proof of purchase. How was she to know that a new receipt should be issued.
I understand both sides of the arguement here but I feel that River Island are being unreasonable.
The tags arent attached though. Most stores would refuse to accept back on that basis as they could have been worn. And the receipt she does have has the item crossed out. Hence why in a earlier post i suggested she tried a bank statement.
And i understand your point but i dont think the shop is being completely unreasonable. They did offer to check the logs. If they were offering to do that and the customer could give them the date/approx date it was exchanged, they'd likely make good.
A lot of stores wouldnt even offer to check the logs, they would just point blank refuse. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

But at no point has it been stated that a new receipt wasn't provided.
What was said was that they don't remember being given it and seeing as Muffinmaker couldn't even remember which day they did the exchange it's not unlikely that they also forgot about being given the new receipt.but I didn't get a new receipt as far as I know because they normally staple the new receipt to the old one0 -
Well I've written a letter to the head offce already so we will see what they have to say about it. Whatever I expect someone who is a branch manager to deal with me with courtesy and respect and I wasn't being aggressive towards her at all. She just couldn't be bothered. The offer to look at the records was half-hearted. She retracted it as soon as she said it by expressing impatience with me because I said that couldn't recall the day that I did the exchange. Like I say, their loss.
Anyway... those that have been disrespectful towards me are showing their true colours. I think you're just being unnecessarily nasty. Whatever, whoever is upsetting you in your life take it out on them not anonymously on a forum which has been set up to champion consumer rights! And none of the "haters" strike me as expert in anything because what a lot of you have said is total poppycock.0 -

To be honest, I don't blame them for retracting the offer to check their records.
It's one thing to look back at their sales for one particular day, but as you yourself admitted that you couldn't tell them which day so what did you really expect them to do, go through all their sales for many days or maybe even weeks?
I must add that your last comment says far more about you than any of your previous posts managed to do.
People don't agree with you, they are "haters". Why bother posting and asking for advice if you are not willing to listen to or accept the advice given?0 -
What advice? Most of the "advice" given has been personal comments directed at me! This is silly... everyone is making out that I went in there guns blazing etc. I didn't. The woman serving me was rude and offhand - it does happen. I will say that some people have been very supportive, but the majority don't sem to know what they are going on about. I have bought lots of clothes over the years and quite often tags are missing and I have taken stuff back that was a mistake with no problems. I haven't had someone refuse me a refund quite in this way.0

OP can I ask why you removed the tags to just try the cardigan on?0

The simple fact is that it doesn't matter one bit what other shops or retailers have done for you in the past.
If they have refunded you without you having a receipt or taking back goods that had their tags removed, this was done on a goodwill basis and they had no legal obligation to do so. (unless the items were faulty).
In the case in question, you didn't have a receipt for the item (you had one for the first item you purchased but not for the exchanged item), and the tags had been removed so they were perfectly at liberty to refuse a refund or exchange.
How would the shop staff have any way of knowing that what you gave them had been legitimately obtained from one of their shops? For all they knew it could have been shoplifted. (and I'm in no way implying that this is what happened, simply that without a valid receipt, they had no way of knowing)Whatever, whoever is upsetting you in your life take it out on them not anonymously on a forum which has been set up to champion consumer rights
And as has been stated many times, your consumer rights do not entitle you to a refund simply because the item didn't fit you.
I'm sorry if you feel hard done by and badly treated by the shop staff, but whilst they offer a return service which is in addition to your statutory rights, you are expected to abide by their conditions to obtain this service.0
