Yes I know I am well read in the speed exemption for the purchase of chocalate bars clause of the RTA.

And how do you know that while that car was exceeding the speed limit, the driver wasn't on the way to an emergency? A call which his control room quickly decided he didn't need to attend, after all?

No, what I'm saying is that it is a stone wall fact that using a mobile phone whilst driving causes a distraction and therefore that in itself is enough to proof driving without due care or attention. Therefore it's better to deal with it via a FPN rather than wasting public monies taking someone to court.
And? Messing with the radio is a distraction. Talking to a passenger is a distraction. Looking at advertisements at the roadside while driving is a distraction.
Are any of these activities punishable with a specific offence?0 -
I've heard so many cases of people, being killed as a a result and the driver walking free, justice eh!
That's ok. All those evil murderers parked up in laybys with the engine on so they can have some aircon while they make their call will all be caught and fined, so it balances out.
Personally I prefered it when handsheld was allowed. The phone users were easier to spot and avoid. Now you have to look out for people who appear to be talking to themselves.0 -

Mate got sent onto a course for using his phone (the sat nav part of it) whilst stopped at a red light.
Police were sat next to him, in an unmarked car.0
