The point being that its been said enough times in various media, that you must not use your phone whilst driving!

I'm afraid you won't get much sympathy in court. Magistrates simply have a tendency to hate motorists, while Joe Bloggs assaults someone and gets an unconditional discharge. However I shall stop before I begin to sound like Richard Littlejohn.

Tp get back to the OP the fact is your where operating a handheld device containing a microphone whilst in control of a vehcicle, as sitting at traffic lights isn't an excuse to chill out you should be maintaining a visual check of your mirrors inpreparation to moving off.
Not true - using a CB (for example) is quite legal when driving.0 -

The relevance is that if you are too daft to know that you are breaking the law and being a danger to yourself and other drivers you shouldn't be on the road.
The driving test has nothing to do with it, and ignorance is no excuse.

Legalities are not in dispute.
What benefit is gained by questioning whether or not the op should be driving?
They ask advice because they are unsure of something. Would it not be better to offer the worldly knowledge you have? Or attempt to question their abilities?0 -

Also if you wish to stop and use your phone to make/answer a call or to text don't stop in a stupid place.
I've had drivers in front of me trying to stop on single lane roads because the roads have no markings but as the roads are used by lorries and buses, and has blind spots then stopping risks something ploughing into them.I'm not cynical I'm realistic

I have personally been cut up three times in the last month all while the drivers were on their Mobile Phones and doing SPEED.
A white van pulled out from the middle lane to the right hand lane when I was going up in it, he had a few words of advice from me for his stupidity.
All I can say is I hope that is whoever choose to use their phone while driving without a hands-free kit I hope you only kill/injury yourself and not another road user - there is no excuse for it.
And seems to me as though the Police couldn't really care!0 -
Don't talk to me about people abandoning their cars in the most inappropriate places to answer mobile phones. They think because they've stopped it's ok to talk...invariably straddled across a junction around where I live. Time to take my digital camera with me when driving. OMG I'm turning into Strider!0
