    It's me that's opening the shop, sorry it's inconvenienced you OP but all my life I have wanted a shop to sell brass band instruments with a rehearsal space in it for local bands. I promise we will not practice past 11pm though.

    If this is going to cause inconvenience my GF want to open a sanctuary for rescued chickens we can put in there instead.

    But hang on a minute here - didn't the OP actually say in a later post that it WASN'T a shop to begin with? Isn't that the point that everybody's missing?

    He's rented a flat about a property which has now been turned into a shop and he wants to know what can be done about that given the letting agent said that the property was going to be left as is.

    Or am I missing something?

    It was an empty comercial property, if it wasn't a shop he could have objected to the change of use. If there was no change of use application it was an empty shop.

    I think it was an empty 'shop/commercial premises/whatever'. He did say maybe he shouldn't have called it a 'shop' as it was empty. (My take on what he was trying to say is that if an estate agents moved in, you'd not really call it a shop, but it would still be in what we generally term as a 'shop premises') so some sort of commercial premises rather than a flat or whatever.

    Think that's what he meant, anyway...

    You'd better hope it's not going to be a takeaway, as they are usually open really late and plus your flat will reek of Indian/chinese/fried food.

    The OP move in 2 months ago, the change of use could have been granted 2 years and 11 months ago for all we know.

    Well the OP should have got something in writing from the letting agent then, without that he is stuffed either way and stuck with his lease.

    Maybe the shop is going to be a shop to shop LA's & LL's! That woudl be ideal for the OP, He'll wonder why he even complained in the first place.

    Yes it was, I hadn't thought through the timeline and timescale.
    I must admit thinking on how the poor dab has been hoodwinked by the letting agent - I haven’t been so shocked since someone told me they have taken the word gullible out the dictionary.
