If the letters are franked, bob them all back in the postbox, they get charged each time you get them back, they soon get sick of it and dont post any more.

now got a letter saying I should ignore all internet advice and look at civil procedure rules part 31. If they are lying, they are very good at it.

It says I should look at parts 31.16 and 31.17 but it only goes up to 31.8. Has anyone on here not paid and not been take to court because I am wishing I has just paid the £60 now.

Emma,

The rules they are quoting don't apply in the county court (small claims) so they are being dishonest. Ignore them. They are trying to force you into naming the driver but as the CPR rules quoted don't apply then you don't have to tell them a thing.

Don't worry, they are scam artists and con merchants.

Do you think everyone goes to Court? You do realise this is a scam just like phishing emails, why on earth do you wish you had paid?

Almost nobody goes to Court, and Roxburghe/Graham White letters chains NEVER end in Court. They pretended to issue a Court claim once but then backed out.

And next time you get a letter why don't you just search for a section of the wording and find other threads where it's been mentioned? I searched using the 'search this forum' option in the top right column of the thread list when looking at the whole forum view here:

Read some of those, see the many instances of 'your' letter going back months and months, people laughing at it, ignoring it. Read what happened - people still ignored these letters and nothing happened.

People 'win' on here every single day just by ignoring the letter-chains and then the companies give up. That's a win, and that will be you as well in the new year.

YES read my signature , all the Parking Charge Notices I have ignored generated letters from Roxburgh , followed by their alleged Solicitors "Graham White".

If you are easily misled and/or scared by letters brace yourself for the next ones which will be from Graham White ..they include such gems as "Notice of Intended Litigation" and "Final Warning" ...it is all a BLUFF.

IGNORE them.

As for the CPR that is a classic bit of deliberate misdirection :-

They "forget" to mention CPR 31.2 which tells you that all of part 31 does NOT apply in the small claims court and they "forget" to mention that claims like their's inevitably end up in Small Claims as they are less than £5k.

Even IF CPR 31 applied, 31.16 and 31.7 relate only to documents. I'm reasonably confident that you don't possess any documents whatsoever that will allow this claim to be sorted one way or the other, AND they know it ..it's just bullying BLUFF.

(Graham White as a firm of Solicitors does not exist , it is one Solicitor who allows Roxburgh to use his name to scare you , that is all)

No, they are very bad at it!

The Civil Procedure rules they refer to are a complex legal process that is normally only used in far higher level cases.

Its application to parking in the Small Claims system is quite preposterous!

Just Ignore them and stop taking the scammers seriously!

You wont find anyone who has lost either!

They send out hundreds of the same letters with the same nonsense every year. Only ever saw one Roxburghe/Graham White claim issued, which was defended and they never attended court. Because they knew they would lose!
