FOS upheld complaint against Norton !

    This is the response to my latest request for information from the fos, claim has been with them for 2 and a half years now.
    Understand the problems but does anyone else have beter news regarding their claims agains Norton via First PLus?

    Thank you for your email.

    Your claim is against the underwriter, Society of Lloyds. This is because Norton Finance were not regulated when you were sold the policy, so we are unable to pursue them.

    The underwriters are the insurance providers, but they refuse to acknowledge any responsibility for mis-selling. They argue that they have no accountability as they were not present at the point of sale.

    There are a number of cases against the underwriter at the Financial Ombudsman Service, such as yours, but there has been no success yet. The Financial Ombudsman Service are trying to find a way to hold the underwriters accountable, but have so far been unsuccessful.

    This means that there is no possible way of knowing how long your claim will take, or if it will ever be successful, because it is still untested waters.

    Where claims are against the underwriter, I would recommend putting it out of your mind as much as possible, as it is likely to be a very long time before there are any developments in this area.

    By all means please get in touch for any updates in the future, but please bear in mind that it is unlikely there will be any for many months.

    We are still waiting but its only been a few months (seems like years already) I think anyone whom is dealing with Norton are in for a long wait they were regulated when we had our loan doesnt seem to make much difference.

    We have now been waiting 19 months adjudicator agreed missold, norton still did not agree so went to the ombudsman last october and still waiting

    How on earth do they keep getting away with this have they ever paid outright, put their hands up and said sorry we were wrong, awful people the FOS should take all their cases straight to the ombudsman....
  • I Have an offer from Norton, it is however not the full amount it is made under alternative redress (i think that is the term for it) which is where they have taken a fictitious amount of 1000 pounds where they believe we would have paid for PPI.

    I have accepted their offer which is around 12000 and am told there should be a payout by the end of the month.....so perhaps near the end now

    I have also been successful with one of mine that were not regulated when taken out the policy (Endeavour) after being told the wrong details for almost 4 years, they decided to uphold on the ppi reclaim.;)

    Have you given the FOS s call recently to find out where your complaint is up to?
