FOS upheld complaint against Norton !

I am very pleased to report that our complaint against Norton Finance for miss seliing PPI has been up held....

However Norton has not responded to the adjudicator so it is now being escalated to the Ombudsman....

FOS confrimed with me today that it is "business as usual" regarding PPI complaints re the banks and the High Courts (though does not stop the banks from dragging their heels) he did comment though that Norton Finance is NOT a bank but a broker, so hopefully in my case at least it might not effect complaints against Norton in the short term anyway.

When I asked how much longer? he said months rather than weeks, look like I am in for the long haul, but hey its been well over a year already so will continue to stand my ground and cover all bases.

    I'm very pleased to hear that you have a partial victory against Norton - as you know mine also went from an adjudicator to an ombudsman and at the time I was worried they would reach a different decision, but it was only 4 months until I heard that the ombudsman had also upheld my complaint - so hopefully you are now well on the way to winning the war!

    Hopefully the judicial review won't delay things too much for you with the FOS at least, although as you know getting Norton to actually part with [STRIKE]their[/STRIKE] our money is difficult at the best of times, so now things probably got a whole lot harder, but at least you're one step closer...........

    I was very interested in your adjudicator's comment re: Norton being a broker not a bank and therefore not being effected in the same way............I hadn't looked at it like that and hopefully he's right!

    Is there no way this can be hurried along 'cos of your hardship status?

    Thanks LL, got everything crossed for you too, think your money due this week wasn't the 15th they promised???

    Apparently that is with being a priority because of our hardship, otherwise I don't think we would have gotten this far yet !!!

    I tried to claim PPI was mis-sold by Picture but since trying to purse a claim and reading this forum it became clear to me that I wouldn't be successful against Picture because my loan had been arranged via Norton Finance! Even though none of my paper work mentions Norton and everything I have relating to my loan is from Picture.

    I recently recieved a letter for Picture stating my PPI cover had now expired and that I was no longer covered! Which altered me to do some more digging. I have now found that the policy only covered myself and not my wife, it was a up front premium added to the loan which then attracts interest too and then it only covered the first five years!

    With all of this in mind I certainly feel I was mis-sold the policy and would like to pursue a claim against Norton now. Does anyone have an example letter or address I could use to start the ball rolling.

    Any advice would be useful.

    Hi there Longwood,

    Sounds like your case is very simular to mine, I pursued Picture and the FSA a for while and was told the Insurance was sold by Norton, even though there was no evidence of this, all I can assume that as a "broker" they are responsible for the actual sale of the Picture product of PPI.

    In the first instance you will need to write to Norton claiming the miss sale, they will investigate and no doubt respond that everything was above board. Once you have their final response you may then go to the Ombudsman.

    I will warn you it will take an awful long time, my complaint has been running since June 2009.

    I used the standard template letter found on this website and wrote that to : -

    Hi Longword,

    Just wanted to reiterate what Clare has said really - this is most definitely worth pursuing as you will get there in the end, but don't expect a quick result!

    Like Clare, my complaint (against Norton although my loan was with Swift) was sent in during the late spring of 2009 and only last month I finally received my refund cheque. Norton will use all manner of delaying tactics to avoid paying out - watch out for excuses blaming the Jidicial Review into PPI - but almost all mis-sold PPI complaints against them are eventually upheld by the FOS. You just need a barrowful of patience and determination to see it through to the bitter end.

    Whatever you do, don't let them fob you off - in my case they produced a telephone recording of the PPI sale which they were adamant constituted irrefutable proof that it wasn't mis-sold. The FOS didn't agree and I now have all my premiums plus interest back!
