    If they change the terms and conditions you can argue that it's a breach of contract and that you should be able to terminate it. The only problem that you have is that you need to pay for your handset if you want to move to a different provider.

    Edited to say: You are probably best of following up any agreement on the phone in writing using recorded delivery.
    I'm not cynical I'm realistic :p

    There is no point going into the shop to settle this. I work in an o2 shop and due to data protection we cannot access a large amount of information and all we can do is tell you to ring customer services. If you get a good sales assistant, they will let you use the company phone. However, its a free phone number anyways thus no point.

    Sounds like O2 are pulling the same stunt as Vodafone. Many people had 'unlimited' data but there was a 500mb fair usage policy, they have now changed it to a 500mb limit and charge £5 if you go over that.
    If that is the case then you will have a right to cancel your policy in a reasonable time of being told of the change as its a fundemental change to your contract i would guess..
  • Thank you for your advice and I will avoid the shop now, have been on the phone to 02 (wasnt to long a wait)
    And they have forwarded my case to a support team....and I SHOULD!!!! hear back within 24 hours on what they are going to do, although that probably wont be until Monday or Tuesday next week and doubt it includes the weekend, they cannot see why my contract was cut.
    Said I would get a positive response within 24 hours.... whatever that means.

    Thank you for your help, and i guess now I just have to wait.

    sorry to hear about your problems with O2. I am not an O2 customer myself, but I signed a contract with Vodafone about 8 months ago, and recently they changed the terms by introducing a hard limit of 500 MB. this gave me, and many others, the right to get a penalty-free cancellation, and to KEEP the equipment provided to us, of course. In case O2 also want to impose a hard limit of 500 MB despite your unlimited internet contract, then DEFINITELY you can make a case and cancel your contract
  • I have a bb bold 9700 and they have capped my internet and not told me, do I have the right to cancel contract with no fees? I'm on 02 please someone give advice thanx
  • I am still trying to sort mine out, and Matt it depends when did you get the phone, anyone who got a phone after june 24th i think it was, is under the new contract where it limits you from october this year that is in, i got my contract in May so have been arguring with them about that and they are looking into that for me.

    if you got the phone before June then I suggest you contact them, I like it was suggested here I rang them and the person i spoke to luckily was very helpful unlike the one I spoke to online. It is worth contacting them as if you took the contract before June like me, and you havent downgraded or anything in that time, they shouldnt have capped your internet they are breaking there argrement else and they have confirmed this with me that they dont know why mine has been cut so are looking into it.

  • Right just had a call from 02 again, and they say it is there fault, and they have lowered my tariff to £30 month with the same mins and Unlimited txts and Wifi still but data is still 500mb they say they cannot add teh unlimited data back on because they no longer do it. Anyway I went for this rather then asking to cancel as I like the phone and can't afford the Iphone 4 yet and they ahve been having problems with that phone anyway

    So £30 I have now got 600mins, unlimited txts and unlimited wifi and 500mb Data allowence with the option to add more if I like, they say the most i ever used in one month was 410mb when i got the phone, because I was on it a lot the first month I got it.
    If you haven't recieved a txt I guess you are ok, just keep an eye on your online account as I wasn't warned about this so be careful and I guess if it does happen then you can cancel, like I probably could have.

    Thats a good deal shame about the data through. I would make sure that you logged into your account to check that they have put you on the new tariff.
  • have logged in adn it hadnt changed but logged in again just now and they have changed it says im now on 02 £30 month iphone contract with data of 500mb, 600mins and unlimited txts and wifi.

    Think when i am due to upgrade might go to a different company though seeing none offer the unlimited data now. not that I have found since looking anyway.
