Banks to challenge ppi mis-selling - all claims on hold

I would say that FOS would not be able to do anything other than uphold the complaints if the banks make no contact.
I was told this by an adjudicator when I asked about the timescale of a bank sending the file to FOS in that if they do not make contact in "reasonable" time then the complaint would usually be upheld in the consumers favour. IF the complaint then went to the Ombudsman and it was upheld again then the Ombudsman's decision is final and binding. IF they continue to disagree then I think the Ombudsman can get the courts involved and I doubt that any court would agree to a bank ignoring the regulator and making their own rules.
Just my view but I honestly cannot see how they can defy the FSA who up to now say that the banks need to continue dealing with complaints and treating customers fairly.0 -

legal action on payment protection insurance (PPI)
8 October 2010
the ombudsman will continue as normal to handle consumers' complaints about payment protection insurance – despite the legal action ("judicial review") launched today by the British Bankers Association (BBA) against the FSA and the Financial Ombudsman Service on the approach to PPI complaints handling0 -
yes they are still handling complaints but norton finance will not deal with them till after court case i dont no all the ins and outs it was a big blow to me after nearly a year and seeing light at the end of the tunnel i can only go on my cicumstances and mine is now on hold0

Hi Blakeney,
As you know I also have a claim against Norton which has been upheld by both an adjudicator and an ombudsman - I was just wondering in the light of your conversation with the FOS adjudicator about your own complaint whether yours had got to the 'legally binding' stage yet?
What I'm most annoyed about is that on many occasions since the decision on our complaint became legally binding, I asked the FOS how much time we should allow Norton to comply and for several months their response was that is was not unreasonable for them to require extra time - thus allowing them to effectively get away with not paying at all it seems!
Many thanks,

Can Martin make a comment on this

In my opinion the title of this thread needs changing since you have moved from ''All claims on hold'' to ''it now looks like Barclays, HSBC, Lloyds Banking Group and Royal Bank of Scotland (RBS) are to put all PPI complaints on hold ...'' and now to ''take it from me that at least one bank will be putting their ppi complaints on hold from now''.
Without offering anything to back this up other than your imagination, this is simply scaremongering.
Frankly you're a menace.0 -
