take pictures of the sofa at every angle so they cant say you scuffed it, and no you cant cancel the finance its with a seperate company and then you would be in breach of contract you can call them and explain the situation to them it kinda gives them a heads up on it.

The fact it creaks suggests to me that the wood is breaking or broken already, mine also creaked when you leaned on the arm of the sofa, dont accept anything but a rejection and them to cancel the finance, im not sure how to cancel finance if its them that has to do it or if you can but id certainly call the finance company and let them know.
let us know how you get on if you check my posts you will see all their excuses and then you will be ready with an answer but do keep calm they dont play ball with you if you get cheeky i know its hard but patience is a virtue in this case.

update:

yesterday i had a call from dfs head office i explained to them what went on sunday instore, they sad they would follow it up, 30 mins later i get a call from the store manager saying sorry about yesterday and he wanted to come out and have a look at the chair so head office musty have gave him a going over, he came out and had a look, the service guy came out today and he was here for 1hr20mins and he put some screws in and it still makes the noise (i didnt authorised any work he just starting doing it and i didnt sign any paper work, the guy did say tho it needs stripping down and putting all back but its if you want that, he was helpful because said if i was you i would reject it and dont take any crap off them,

tbh i dont think he was even qualifed to do what he was doing because he said i only do scuff repairs i aint down for this,

so im gonna put it all in a letter and tell them i reject it i would rather sit on the floor,

sorry for going on lol

just contacted comsumers direct just to log it

do you think this letter is ok? ive only copyed the letter not my address if you know what i mean

Dear David Massy,
Sale of Goods Act 1979 (as amended)

On 03/08/2010, I bought a CERA 3 seater sofa CERA power recliner chair from you for £1404 which is not of satisfactory quality.
On the 4/10/2010 yourself (Mr. David Massey) attended the property to inspect and confirm the following fault,

The problems are:
• CERA power recliner wood frame creaks.

DFS arranged for a repair worker to attend the property on 05/10/2010 at 8.30am who attended for 1hr 20mins trying to fix the fault but failed.

I wish to reject the goods and claim a full refund.

Please respond to my complaint within 14 days from receipt of this letter.
Yours sincerely

Mr. C Thompson

Hi chris, the letter is fine the only thing i would have added would be i wish to reject the goods and claim a full refund under the sale of goods act 1979 as they are not fit for the purpose.

However after you hear back from the manager which you will cause this is what they do he will try to get you to exchange the sofa for another everything and anything but a refund, thats your cue ie if hes prepared to exchange then its faulty so your reply is well under the sale of goods act i want to reject the sofa for a full refund. He will then tell you he will call you back in a few days and then he will relent and uplift the sofa and you will get your full refund hopefully if it isnt that phonecall it will be the next. patience and playing their game is the way forward. keep us posted how its all going. Hope this is helpful

05102010095.jpgas you can see hes put a screw IN the leather
05102010094.jpgother side as you can see no screw(there shouldnt be one) so the screw on the other side shouldnt be there

05102010091.jpgstaples hanging after his poor workmanship,

you guys are gonna get sick of me lol

UPDATE;

dfs have just phoned me and said would i be happy for them to take the chair and have it repaired, i declined there offer and told them about today repair that i wasnt happy, i told them i took pictures and will be sending them to the store manager, she was all sorry sorry about this, i told her that i would like a full refund and the good be taken away, she said she is going to send out a manager to have a look at the repair before this decision is made. she said mr thompson carry on useing the sofa because its no fault of yours. ( i wont be doing that, that will just give them more ammo for them to say you have damaged it.

Hi OP

Hope this gets sorted for you - i had a similar problem with my mums sofas which she ordered from Harveys. I wont over take your thread but needless to say, we ended up getting a full refund after i roasted the manager down the phone and told him in no uncertain terms that id be happy to do the same in front of all of his staff and customers in store.

All of these big furniture companies are the same. Hold strong, tell them that you insist on a full refund immediately. They dont need to come out and take ANOTHER look at it. Tell them to make sure they have a van to take it away with them if they insist on coming.

Go to your local furniture store for your next chair - im sure you'll have one close to you. Ive just ordered mine from Hopewells in Nottingham who are a family firm and theyve agreed to bring a sofa out to my home to trial it to make sure the one ive ordered will go in! If not, then i can cancel my order or choose something else if i wish. Couldnt ask for better service!!!!
£2 Savers Club #156! :)
