Mobility query can other family members HAVE the car

  • I think a lot of this confusion is due to the ABUSE of (Motability Finance, a Charity set up to aid people with mobility problems) which already exists. The car is to be used only for the benefit of the person whose HRM is being used.

    As for cars being insured for business use they can be.. I've had HRM for many yrs and without a car through this scheme, I'd have had to give up work a lot sooner, but then the car is to aid MY mobility not my childrens/brothers/sister/aunt/uncle or anyone else who thinks it would be good to have a new car.

  • If your brother is your mother's registered carer there will be a loophole where he can obtain the vehicle; obviously her payments would be taken by Motability.

    That only applies if she receives the higher rate of mobility.

    I have to say though, I tend to agree with 'welshmoneylover' - it doesn't sound like your brother is trying to do this in the best interests of your mother so it could VERY easily be seen as a fraudulant claim and your mother, your brother and possibly even YOU if you are legally in charge of her finances could get in all sorts of trouble.

    Sorry not researched it so unable to say, I'm sure there will be reports/stats available if I look hard enough... However, I speak from what I personally have witnessed, and there are many who do drive Motability cars using the HRM of a family member and not to the benefit the claimant.

  • Misuse of the Car Scheme

    Misuse of the Motability Scheme is something we take very seriously. We rely on the general public, customers, police, Department for Work and Pensions, and others to help us put a stop to it. Every report of misuse we receive is carefully assessed and, if proven, acted upon. Typical examples of misuse include:
    • Using the car for crime
    • Denying its use to the disabled person
    • Using the car as a taxi or delivery vehicle
    • Driving uninsured or whilst banned
    • Sub-leasing or selling the car
    • Allowing the car to become unroadworthy.
    You can report misuse to us either anonymously or, preferably, by giving your name in complete confidence so we can discuss it with you further if necessary. If you want to report something, please use the Reporting misuse form, call us on 0845 456 4566 or email [EMAIL="spu@motability.co.uk"]spu@motability.co.uk[/EMAIL] If you represent the police, a local authority or other body concerned with combating fraud, please call 01279 632233 for a guidance booklet.

    The rules do specify that car is for disabled person or to be driven by others (usually 2 named drivers) for the benefit of the disabled person. Hardly benefits the disabled person if a son etc uses it for personal use day to day does it? Could broadly come under denying its use to disabled person or sub-leasing - that would be up to the mobility scheme to decide. If person is unsure why not just ring up mobility and state what the type of use will be and see what the response is? :)

    Somehow I don't think so!!! Unfortunately I know a few folks who use the claimants car as their own. I get HRM and could get a car if I wanted. I don't know how to drive!! and my neck is a problem. For those who let others drive the car , Just tells me that maybe they didn't need it in the first place. just a thought

    As you say 'somehow I don't think so!!!', I said that because I certainly don't think he would either! He just wants to get his hands on a car for his own.

    Hi snop208, yes you could get a motability car as you are receiving HRM and it doesn't matter if you don't drive. If you have someone who does drive, it helps to take you wherever and whenever you need to go.

    If you don't want/need a car for your mobility needs you can use your mobility component for the use of taxis for example or get a mobility scooter etc. Most people need to go out and about at some time or other and motability is just one option that is available to people receiving HRM.
  • I was the original poster and have had to re register as password forgotton. YOU ALL have been so great and spurred me on to say NO with conviction and knowledge. I cannot thank you enough. Incidentally the brother has now been removed from assisting me with handling mums affairs as other issues have come to light! Mum has since told me how relieved she feels that I am back in sole charge. Bless you MSE members.
