i dont alot about this but am i right the car can only do so many miles ayear so it may do far more miles than it should

someone also seems to be confusing the free car tax scheme run by the DVLA with motability,they are 2 different issues
They are two different but related issues. A motability car is registered as a disabled vehicle and as such is exempt from road tax. Therefore the registered user must comply with both motability and DVLA rules.I'm a retired employment solicitor. If your brother uses the car for work then it will not be available for your mum to use when she most needs it. Tell him to save the £49 a week for a while and go and buy a used car.0

Can anybody tell if it's fraud to have a motability car and not be the claimant?. A relative pays her mum the money of the DLA high rate mobility and swans around in a brand new car, which she uses for own purposes not to help mum out. I don't think she even lives with her. Is she abusing the system?.0

I would say that's taking advantage of the Motability Scheme somewhat!!
To get a Motability car you have to be the claimant i.e. receive High Rate Mobility DLA so the car will be in your name and you can nominate (I think) 2 other drivers for insurance purposes.
It's sounds dodgy what she's doing and I think her mum risks loosing the car if Motability found out.0 -

As others have said YES it is definitely fraud. Obviously if she isn't the claimant she certainly isn't eligible to get a motability car!
The awful thing about it is that not only committing fraud but she is putting her mother's claim of HRM DLA in jeopardy because if caught, not only would she have to give the car back, her mother (she too would be seen as committing fraud) could very well have her allowance taken from her.
If your relative had the car taken from her, would she still give her mother £49 per week for the allowance she has lost??0
