  • Just received second letter arrived with DEBTOR on the envelope think they are trying to embarrass me. Notification of Intention to pass to debt recovery team Name spelt wrong, figures different on the notice. Any advice. Should I write stating I was not the driver and have no intention of stating who was like Martin states or not contact at all. Being threatened by court appearance, CCJ's and bailiff to remove goods. Please advise.

Send the envelope back to them, after crossing out the word "debtor" and write "CHECK ENCLOSED" in thick felt-tipped pen. Don't put a stamp on it.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

    That could well be illegal.

Section 40 of the Administation of Justice Act 1970 makes it an offence for any person, "with the object of coercing another person to pay money claimed from the other as a debt due under a contract, to
    (a) harass the other with demands for payment which, in respect of their frequency or the manner or occasion of making any such demand, or of any threat or publicity by which any demand is accompanied, are calculated to subject him or members of his family or household to alarm, distress or humiliation"

Continue to ignore, but keep this valuable evidence with a view to either having the person responsible prosecuted, or have any civil claim dismissed if it reaches court.

That envelope is shocking. Keep it and report them for harassment (a criminal offence):

    http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=03_harassment

So it's your choice if you look at that link, letters to your MP and the OfT etc. would be a good start bearing in mind you owe no debt at all and no contract has been established with the registered keeper (and never can be).

But don't bother to respond to the scammers themselves, please. You just have to ride the pathetic 'storm' of threatograms and then it all fizzles out if you don't reply.

  • Thanks Coupon-mad I'll ride the storm, I was annoyed to think the postman would have seen debtor when posting. Good job I have you all giving me the confidence to ride this out.
  • hi please can you tell me how you got on with ignoring them?

i've got a letter / ticket from them but the pics doesn't show where my car was..

what happens if i just ignore it? can they keep pursuing me?
  • You can almost guarantee that had anything transpired after ignoring they would have been back here. Continue ignoring as does everyone else on the ppc threads, have a good read.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

Ignore they will eventually realise you are not playing and stop the letters.

They can keep sending you debt collector letters if they want, which you can ignore.:p

This is NOT a real fine, you owe this private company nothing at all even if they could prove where the car was it makes no difference. Even if you parked sideways across a mother & child bay for seven days and they had pictures of the car they couldn't make you pay because it's NOT a fine.

Read up on this scam a bit more, start with at the top of the forum board, read all the stickies (except the ParkRight one which is not relevant). Look at the pics of the debt collector letters we have all had, and ignored, and lived to tell the tale with no effect on our credit ratings (of course):

    http://forums.moneysavingexpert.com/forumdisplay.php?f=163

Make sure you click on the links on the threads, look at the Watchdog programme (their example ticket had a pretty picture of a car on it as well, just like yours, big deal!). Watch the Watchdog link and see what the legal expert tells you to do with such a bogus ticket.

DO NOT EVEN THINK ABOUT PAYING, IT WOULD BE LIKE PAYING A PHISHING EMAILER.

Hope that's clear, get reading the board threads and tell your friends and family about the scam.

Watching with interest as I've just had the first "demand" from these clowns (here's my thread). You seem to be slightly ahead of me, so your postings are letting me know what to expect.

I've scanned my "ticket" and first letter and added them to the relevent thread so hopefully someone will merge them with the opening post soon.
