How to sue a company?

  • Perhaps its beacuse you asked who you could sue. If you'd asked if you could complain to you would have got a different response.

    Perhaps its because the Great British public are fed up of coughing up compensation for 'hurt feelings'

    As I said ....if they'd shut their mouh, said nothing and just changed the reciepe - would YOU have been any the wiser. Must admit if their letter had crossed my desk I would have binned it and said nothing but hey ho.

    From a legal perspective, you cannot just sue out of principle. You need a cause of action. Unfortunately, 'violating your principles' is not a cause of action that would allow you to directly sue to the company. By all means if you want to make a complaint to the company, or complain to the relevant regulatory body, then do so. But civil litigation through the courts is not the answer here.

    The reason why the response has been hostile is because your first post came across very strongly that you wanted to sue as an opportunistic action to make a gain for yourself. That is generally frowned upon, and rightly so. But in any event if that was not your intention and you just want to be a white knight for justice, regrettably that is not your role.

    For the record, suing a company isn't very difficult. You just name the company as the Defendant and issue proceedings at the company's registered address. Easy. Of course for negligence and such like you will generally have to identify staff members' actions that the company is vicariously liable for, but this is not anymore complicated in itself than suing a private person in the same circumstances.

    Do you religiously check the label on everything you consume?

    If not, you will probably need to complain to a few more companies...

    I think you have the same vending machine as us here.

    Our vending machine has had a label recently added (handwritten, by a member of staff) advising that it is "not suitable for vegeterians". On the "offical" label it has "suitable for vegeterians". This applies to both the minestrone soup and the vegetable soup, and possibly another flavour as well.

    Not sure if there is anything you can do really. It may be up until now, it has been suitable and they have/are about to change the recipe, thus then making it unsuitable.....

    What if the animal that the produce came from died of natural causes? would that be ok to eat?
  • I would write a letter of complaint to the comapny involved, you ll probably get an apology and some vouchers for soup (proper veggie Soup). What more would you want? At the end of the day it was an accident not Malicious.
