Thanks Sandra. I talked to a friend of mine on Saturday who went BR and he said the clerk in the court altered his figures. Maybe different in som ecourts perhaps?

It could possibly be yes, or maybe that clerk was just being helpful? Sometimes these officials can be wonderfully kind and sometimes not. Or it could be that one or more of the figures seemed overly excessive at first glance? Who knows.

At the end of the day it is the OR who wields the big stick!!

Scoot, do read the post two above re holidays. Did you include any allowance for a holiday in your SoA? As I said, maybe you haven't had a holiday for years but it doesn't mean that you cannot plan for one once you have your finances under control.
In your IVA you were not allowed to claim for a holiday at all ,but in bankruptcy you are!

I put down £60 for birthdays/holiday/xmas combined. Is this okay?

Try and sit back and relax for a bit now then, hard to do I know, soon you will be wondering what all the fuss was about, and telling us all how nice everyone was at the court!

I would wish you the best of luck, but you wont need it, you are well prepared, and it will all go fine.

  • I knew there would be something.

19 hours before court, OH has been informed that the wages for this month have already been finalised, and bank details can not be changed until next month.

Will OR release his wages from Barclays account (no debt with them, thankfully)? Our SOA is pretty much penny for penny income=expenditure.

Ben gets paid on Thursday, so probably won't have had OR interview by then, I guess, so do I just ask to speak to them as soon as bankrupt to explain?

Is it a difficult process getting money released? Barclays have already told us that despite no debt with them, there is no way we could keep this account, it will be frozen, but 'you can get an account with a cashcard!' Lucky us!

I fear that we could have our first BR month defaulting on all our bills.:o

I realise that it is the bank that freezes the account, not the OR, but as the bank has told us it WILL freeze it permanently, can the OR instruct the release, or does it have to go to court, etc, for an order to be made?

The OR writes to the bank and asks them to keep the account open if it is for wages. This will be done as soon as you have actually given your bank details to the OR, so I guess with a letter, it would be a day or 2 later when the account actually gets frozen.

Mine was left open you know, with a full debit card and cheque book...

I guess I always thought if they freeze the account, get something in writing from the OR (I did) saying they dont want the account and go to the bank and dont leave until you get your cash.... That was my plan anyhows....

  • Also, you need to "lose" the £30 for pets in something else - the OR will disallow it. I am an animal lover myself and I think that the ruling on pets is very wrong, but they are removing pet details and pet insurance from SoA allowances. Why not add the £30 to your food bill, just so that it is not listed separately? When will they realise that for most of us pets are part of the family - even if it is rat! I have a friend who keeps rats in her living room! She adores them!

It does seem to be a strange ruling. I will happily 'lose' the £30 into my food bill, thanks. My babies are in the living room too! They mean the world to me, they're gorgeous!! :j
