  • Thinking about this, surely all ORs have to work to the same rules? It can't be a "postcode" thing like medical matters can be?

    Could this be a sign of the insolvency service enforcing the rules 100% to make examples of us? Maybe as a deterent to others thinking of it in the future as a copout?

    I was told off the record that they would not allow for birthdays, gifts, xmas etc. and to increase the food allowance to it's maximum even if you don't spend it all, so you've got some spare cash to tuck away for xmas/birthdays.

    I'm going BR around Jan/Feb time unless someone else does it for me in the meantime.

    not nosey at all, that's why we all post here so we can learn and gain from each other

    she took out all pet costs (food, litter, insurance, cat club memberships), birthdays/christmas/holidays, subscription to charities related to my health problems, sky (obviously).

    didn't quibble the values of any other figures, even where I've got £400 for groceries for two people per month!

    pet costs (or at least some of them) may go back in if my gp will agree to write a letter stating that they are good therapy and have improved my health since having them

    and sandra (and others I think) say that b/c/h is allowable, so I've to follow that one up too.

    Doushka, I had a look back at your posts and I see you also have an Income Protection Policy payment. I would say that is where the discrepancy comes in.
    Having said that, the OR is still not allowed to touch one penny of your IB or your DLA. It has to be removed from the income first. Then take off your outgoings.

    If you do this, how much "disposable" income do you have?

    I would argue the point with the OR re your DLA since it is neither taxable nor included in any calculations.

    thanks Sandra, I was going to say that about the IPP, but you got there first :)

    If I exclude the DLA and IB, my surplus is actually a deficit of over £300!

    Is there somewhere that it clearly states DLA and IB will not be touched?

    I think I need a letter (as that is her preferred mode of correspondence - great at this time of year eh!) pronto don't you?!

    The OR is being a pain in the you know where!

    Bankruptcy allows for birthdays, Christmas and holidays. It allows you to have a normal life again, free from debt, etc.

    I would query this with the OR, since it is one of the two big differences between an IVA and bankruptcy.


    Again, this is one of the things the OR excluded from my expenses. Is there anywhere I can refer to when I query this with her?

    and, out of interest, what is the second big difference? (its probably clearly in front of me somewhere obvious, too obvious to see)

    has the sense of relief settled in yet bloomin freezing?

    was it nice and straightforward for you at the court?

    (in hindsight I don't know why I worried about the court thing, its the OR that was the tough bit)

    please tell me youre not still getting unwanted mail from creditors etc - I'm only newly br and am loving the reduced post of that kind (now if MBNA and associates would stop harassing me by telephone I'd be doing ok)
