    Perhaps they check to see if the premium bonds have won anything and then claim the winnings? :confused:

    I checked my number on line the day before my interview - zilch!:rolleyes:

  • Hi everyone! I am really sorry if I'm going about this all wrong, I have never used a chat forum before! My friend showed me this one and I've been reading it all morning - what a great site! I am going bankrupt on the 26th Jan and I'm pooing my pants! I took advice and decided this was the best way forward. But I was told that in order to raise the fee, it was legally acceptable to stop paying my debts for a month or two. I wasn't going to be able to raise the money any other way, so I cancelled my direct debits. Now, I'm getting anything up to 18 phone calls a day from my creditors! I've put all phones on mute and have well and truly stuck my head in the sand. The advice made sense at the time, but it has made things so much worse! Was anyone else advised to do this? Now I'm worried that it will go against me with the OR and that I'll be found fraudulent!

    please dont panic most of us on hear all did the same thing before we went bankrupt ,one bit of useful advice would be to change your number ,i and a few others on here did and it stops the calls .the OR did not even ask me about cancelling all my DDs and from the feedback on the others OR meetings on here no one else was asked either ,as you will have read from all our posts on here we all were nervous wreaks leading up the bday but the whole process isnt really that bad i promise you .

    Hi B&B - and welcome to the Bankruptcy Club.
    First of all - you were given the right advice about not paying your creditors - what can they do? In a month's time you will be declared bankrupt and they will have to deal with your OR/trustee. In the meantime, unfortunately, they WILL harrass you - you can try asking them not to call, but they probably will ignore your request. Even if they were to issue a CCJ, then the chances are that they would be unable to get a court date before your br, but, in any case, you could tell the court, in your defence, that you have a bankruptcy hearing on 26th Jan.
    In the meantime - don't worry. Your creditors can not send you to jail, nor can they send in bailiffs, without a CCJ. In 6 weeks time, you will be able to tell them that you are bankrupt and they WILL leave you alone.

  • But I have so many questions!!
    Here's one of the main ones...
    My car is about 5 years old and if I had looked after it, would be worth about 4K. (At least that's what they are up for on Autotrader!) Realistically, if I sold it, I'd get 2.5 to 3K. I'm guessing that will be considered an asset. The car is registered to me, but my Dad owns the finance. Something happened earlier in the year, and my Dad and I are no longer in any contact at all. I did a HPI check on the car about 3 months ago, thinking I could sell it and pay some debs off, but there is still HP on it. I contacted the company who own the finance and they won't tell me anything at all. What will happen to my car, will it be taken?

  • First of all B&B I would doubt that your car is worth as much as you think it is!

    My car cost £16000 in July 2005. It is now worth barely £4000.

    So, a five year old vehicle is not going to be worth a whole lot. Technically, since the finance belongs to your Dad, he owns the debt. If you point this out to the OR I doubt you will have a problem. Also, if you can suggest that you need to the car for work, etc, you are usually allowed to keep it.

    I cannot get rid of my car - I sent the Voluntary Surrender letter to Capital Bank plc last Monday, by Recorded Delivery. I have heard nothing from them. The Royal Mail don't bother to get signatures for RD, so it is not coming up on the royal mail website as having been delivered.

    I had spoken to Capital on Monday, who said they couldn't take my car away for me. The insurance ended at Midnight last Wednesday, it is parked on the road and is totally in the way!
