Thanks for that, I know that I'm panicking!
The other main concern that I have is regarding my joint account. It has a huge overdraft on it so I couldn't get my boyfriend's name off the account. I suppose the bank will go to him for the money, but he is with a debt managemnet company and so he can't pay it!

Oh no! now I'm managing to post the same thing twice! Can you tell that I'm new to all this? Thankyou everyone for your replies, it's so comforting to find people who are doing / have done the same thing!
Dawn :-)

My car cost £16000 in July 2005. It is now worth barely £4000.
So, a five year old vehicle is not going to be worth a whole lot. Technically, since the finance belongs to your Dad, he owns the debt. If you point this out to the OR I doubt you will have a problem. Also, if you can suggest that you need to the car for work, etc, you are usually allowed to keep it.
I cannot get rid of my car - I sent the Voluntary Surrender letter to Capital Bank plc last Monday, by Recorded Delivery. I have heard nothing from them. The Royal Mail don't bother to get signatures for RD, so it is not coming up on the royal mail website as having been delivered.
I had spoken to Capital on Monday, who said they couldn't take my car away for me. The insurance ended at Midnight last Wednesday, it is parked on the road and is totally in the way!
Good luck
WOW... Sandra... You and your pimp mobile ! What car do you have hun?
Anywhays... how are you, havent seen you around for a bi 10 -
It is a Citroen Picasso.
I got my Motability car on 13th, a Ford Focus Climate automatic.
I have been unable to use my laptop for the Internet for FOUR weeks! Finally, got it sorted out. I can sit here, watch Corrie and type at the same time!
Have been thoroughly depressed. This cold weather plays havoc with my arthritis and I don't want to set foot over the doorstep.
I can hardly wait for the New Year to come and hopefully 2007 should be better than this year has been!0 -

I was reading your earlier post about your car going from 16000 to 4000 within a year and half and i coudlnt believe the depreciation.
Should of known it was a citroen because they are one of the worst cars to lose money on.0 -
Hey guys n gals - sorry I've not been about for a bit, I have missed you all though!
And don't have the energy to catch up on the posts I've missed - sorry
Just had my phone interview with OR. Talk about gruelling! I'm knackered now. She was very matter of fact, but I definitely felt under interrogation which just made my memory and word loss worse!
Hey ho.
I lose my endowment policy, no great surprise, but I was hoping to keep it as I am unlikely to ever be able to get more life/health insurance and have nothing more than state pension for old age (yes I know, its a long way off)
Keep my car - I'd like to see them take it away from a disabled person lol
Then the good bit (not)... out of my 'essential' expenses she took out £265 leaving me with a large surplus. Fortunately she didn't quibble any of the figures I'd given, perhaps I should have inflated them somewhat. But then proceded to say that as it stands, I would be looking at an IPA of £380pm.
Gobsmacked!
My partner has been footing the household expenses for the last I don't know how many months so that I could keep on top of my debts. Take my debts out, put in my contribution to the household expenses, not allow more than £250 of costs that will be incurred monthly (I mean you don't suddenly go get rid of your pets just because you've gone bankrupt do you - and no, that wasn't all that made up the £250) plus expect me to pay that large and IPA... I don't know if perhaps I'd have been better off not going bankrupt, at least I could then theoretically try to get credit to help me live.
So anyway, action points for me from the OR are to:
1 - go to my GP and get a letter confirming that my cats are actually good therapy and have improved my health. I explained to the OR that I was bed bound before-cats, but now I have a purpose, I have to get up to feed them and clean their trays etc. They have helped improve my health and I am only predominantly house bound now (can get out a bit) as opposed to bed bound
2 - review my expenses and see if I can include a figure for rent to my partner - its his house you see.
3 - send her the policy docs for my endowment.
But I've just had a thought....
Before I got ill (ie when I still had a proper income), my OH and I paid rent and household bills split 50:50. If I were to show that on my SOA ie put in a rent figure that I pay him, it would take the surplus the OR is calculating down to £160 and then with the weight of the GPs letter, I may be allowed to include some cat food/litter/insurance too!
Does that sound logical to anyone or am I talking out of my hat?BCSC # 29 - BRD 29/11/06ED 31/08/07 phew!

What do you mean by "£265 was taken out of your expenses?" Sorry if this seems nosey but I'm going to be doing my I&E sheet soon so want some idea of what was declined0

Doushka I am amazed!
Your income is all State Benefits, how can the OR take anything? To their own rules they are not allowed to touch ANY State Benefits.
Your car is yours but it is paid for through your Disability Living Allowance.
I would challenge everything that this dozy OR has come up with. This is ridiculous0 -

Hi Doushka,
Can only agree with Sandra - OR should NOT have given you an IPA/IPO if your only income is from state benefits - your partner's income does not even enter into the equation.
You NEED to get back to her ASAP.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
