Yes, you need to phone the Court!! I thought I could ring and make an appointment for the same week - ha! My wait was four weeks!

I think that site is sadly lacking in a lot of ways. The information is as clear as mud for some things. Also, it should have sections where you can add notes to it, by way of explanation.

    Good Luck!
  • For those fo you whom have gone through bankruptcy -

Did you tell anyone you were going to go bankrupt?
    Just curiosity.

    I haven't mentioned it to a soul.

I have a friend G who had a lot to say when a mutual friend of ours went br nearly five years ago - she kept saying "all that money and she doesn't have to pay a penny of it back" . I don't know how much her br was for. I have never been able to work out whether she was jealous of her not having to pay the money back!

Would be interested in your replies

I told a few really close friends and my immediate family (dad, sisters) as it would or could personally affect them. On becoming discharged I told a few more people and they were totally surprised even though I was a physical and emotional wreck at the time I declared myself bankrupt and thought the world and his pet dog noticed!!!

As for 'all that money and she doesn't have to pay a penny of it back' - What a load of old rubbish. I had to pay a substantial percentage of my salary towards my debt and feel that I DID pay back what I was able to.

  • Hi there, I'm completely new to Chat Forums! I've been reading this one for a few days now - you all seem like a friendly bunch!

I'm going bankrupt today - hopefully. Strangely different to many who have posted on this site...I haven't needed an appointment, I just need to turn up.
Its quite scary really - I've never been near a court in my life.
My husband was bankrupt last year and has been discharged now for 5 days, however in the time he was bankrupt we accrued more debt on my cards, as he obviously didn't have any! This coupled with his being on incapacity benefit for the past 18 months has just made life really tricky - paying the rent has been a major juggling act! I foolishly (I realise now) took out a loan to consolidate the debts, bad idea - the payments got even more unmanageable, and we ended up living on a credit card!

So, after many weks of serious stressing, sleepless nights and so on - I got the paperwork from the court, and I'm off in about an hour to the court.

I have loads of mixed feelings - guilt and shame, but also looking forward to the relief you all keep speaking of! I know the next year certainly isn't going to be easy...and christmas is not looking too cheerful right now, but I can only see this as a positive thing. It's got to be better that the stress I've been putting up with recently! Anyway thanks all for all the info you've put out here - it's been so helpful.

    Thanks.
It's a big step, but so worth taking:j
  • Good Luck! Let us know how it goes.

    Which area are you in?

I thought I lived in a relatively quiet area and thought I could just walk in. Good thing that I phoned them first! Unless it is due to the number of people going bankrupt maybe?
  • Whilst I am self-employed but on Incapacity right now, I was employed to work part-time for the county council.

I am in dispute with them over Breach of Employment Contract.

I am in the middle of taking them to court.

Since they don't have a leg to stand on (in the solicitor's lingo!), I am expecting that I will get pay for 2007 + compensation + extra since they ignored the Grievance Procedure.

All this is going to happen whilst I am in bankruptcy.

I know that if you are on an IPA that any extra income, ie overtime etc, is split 50/50 with the OR. What about the payout from a Tribunal? Does that work the same way?

I just want to know where I stand. If they OR is going to take 100% of the payout I may aswell not bother. It would not be worth the stress of going through it all.

    Any advice would be wonderful!

    Hi Mike,

Glad to see you back - the club is going from strength to strength and is becoming an excellent source of advice and exchange of views - might even become a 'sticky' one day:rolleyes:
Anyway, last week went well - I was only in front of the judge for about 2 minutes and he was a perfect gentleman - not at all judgemental - and wished me well for the future. I am still waiting for my OR appointment, but that can take a couple of weeks.
I hope yours goes as well, next week:beer:
Don't forget the numbers - we need as many new members as we can get.

    Cheers
