I don't know how old your son is / will be in 2013; but I'm sure I read that under 16s won't be sent for medicals.but I don't think a medical is going to be straight forward, a lot of my son's problems need to be seen over a period of time to appreciate them.

Even though my neurologist is likely to know much more than the ATOS doctor?
Here we go again.
Those with the best, most complete, independent evidence are more likely to gain the benefit than those that don't have that option or maybe don't have that quality of medical opinion.
Is that right? Where is the fairness?

Andyandflo, if you are worried about being take back 'in', I would take some time to investigate your rights, can they section you? Perhaps a change of GP may be needed.
Thanks for that. Even if I wanted to change GP, the choice isn't there. I live in a village with one practice.
Under Mental Health rules my rights are very limited.0 -

Of course it is right. You have the option to get independent evidence, everyone does. You choose not to. If you're over 60, then you can claim pension credit.
You're forgetting this person's other threads. He doesn't want to claim Pension Credit because he wants to work as well. He wouldn't be able to keep much money if he was on PC but he's worked out that he can work and keep a lot if he's on IB/ESA and DLA.0 -

He says that he can't work due to his illnesses. He says that he has been put on JSA which he says isn't right! He disagrees with this decision! He won't see his GP and blames his GP for a bad report which led to him failing in his claim for DLA - he knows he is entitled to DLA!
He blames everyone else and won't help himself. He is very bitter towards others who have been awarded DLA and says that the system is unfair. I have no objection to anybody assessing me but I was never offered the choice. I was turned down without it.
I don't see anybody anymore regarding my Mental Illness problem. I refused in 2004 to anything more to do with them despite them sending me appointment letters.
I will not tell my GP for the reasons I have mentioned earlier. I know what they will do with me and there is no way I am going back into that!

CAB filled out the original ESA claim for me after I went there to ask about what help should I be getting. They then referred me to DIAL, who asked a lot of questions and suggested that I should be entitled to DLA. They filled the claim form out for me.

That is quite correct, I have a sick note that takes me to March next year. No doubt if I listed exactly what my problems are you would refrain from commenting.

I had to because I failed the ESA medical and that is what the letter said I had to do. Yet I continue to get sick notes and my consultant says that I MUST not work.

No I wont see my GP about my Mental Illness. I do see him for everything else. I choose not to bring the matter up with him as I believe I know what will happen. I applied for DLA only in respect of my Mental Illness, not for anything else. My other disabilities are not related to it and therefore not relevant. The previous DLA claim was for the Mental Illness only - so I was only carrying on a previous claim. I still receive LRM for Mental Illness.

That is correct. I had HRC/HRM in 1995 for life which was obtained for me by my social worker/CPN & Welfare Rights. They did everything - I never asked them to do it for me. Between then and 2004 I managed to get rid of everything except the LRM. Try as I may they would not remove it despite asking for repeated reviews. I had so many arguments with my CPN/social worker over this.

Yes it was. I couldn't accept that being normal included receiving a benefit that said I was ill, needed care and had problems with mobility. That is why I asked for so many reviews. At least one every 3 months if I remember right.
This was all part of the problem that saw me being put away. I refused to co-operate with people who I saw as interferring in my life and became angry and aggresive.
Maybe this will explain it better. You seem to have no conception of what life is like outside your own little bubble.0 -
