this is an actual email regarding my PD11
I had a company car and a fuel card which I gave back in March 2012 as I WORK FROM HOME and only drove the car 1,500 miles in the whole year. They have assessed my diesel liability at over £6,000. My actual diesel usage was less than £1,000
You have to read it from the bottom up:
Hi C*,
Unfortunately, the taxable benefit calculation for company car fuel is set by legislation and therefore HMRC will not take into consideration the actual cost incurred. As such, going forward you may wish to consider whether it is beneficial for you to retain your fuel card or not.
Additionally, the following may be useful to you regarding tax relief which you could be eligible for.
Business mileage tax relief
You are entitled to claim tax relief in respect of the business mileage driven for work purposes. The tax relief is calculated according to a simple formula:
45 pence per mile for first 10,000 miles and 25 pence per mile on any business mileage thereafter. (e.g. if you drove 5,000 business miles you can claim tax relief of 5,000 x 45p = £2,250. So if your fuel spend on your fuel card was £4,000 the amount on which you will pay tax can be reduced by the tax relief available (£2,250) with the resulting taxable amount of £1,750.)
The tax relief has not been included on the P11D because the claim that you can make is not supplied to HM Revenue & Customs as part of the P11D process, we cannot “net off” the two amounts for you.
As mentioned above, it is not possible to give effect to this relief by setting it against the benefits reported on the P11D. You can however make the claim for tax relief either by:
· entering the above tax relief figure into box 17 of the employment pages of your tax return,
· use box 2.5 if you will be completing a “short” tax return, or
· by completing form P87, by using the link below, if you do not complete a tax return.

Making the claim to which you are entitled will reduce the amount of tax you will otherwise have to pay on the full value of fuel paid for by Cisco.

Thank you for your prompt response. It is true that I had the car for the duration as started below, and that is not in dispute. What I am still trying to grasp is why HMRC wouldn’t want to have the accurate amount of diesel that I used so they could charge me tax fairly.

Thank you for your email.
According to the information provided to us, the car was provided to you from before 6 April 2011 until after 5 April 2012. As such, the company car benefit has not been pro-rated as it has been provided for the full duration of the 2011/12 tax year.
Regarding the fuel benefit there are different rules relating to the provision of private mileage to company car drivers and as described on page 2 of your P11D the company car fuel benefit is calculated in accordance with legislation, rather than being the cost to Cisco in providing the benefit to you. This is because there are special rules in respect of company cars.
The benefit is calculated by multiplying a deemed amount (£18,800 for 2011/12) by a percentage derived from the car's carbon dioxide (CO2) emissions. The relevant percentage is 35% for the company car you have chosen.
We trust this helps to clarify matters for you however please let us know if you would like us to follow up with Cisco to confirm the dates the car was provided to you.

A couple of things re your 8:35am post.
You can't have given your car/fuel card back in March and have had it for the full tax year (05/04/2012) - either your March comment is wrong or you've told your employer the full year benefit is correct when it isn't.
Don't be confused by KPMGs comment re business mileage relief, this applies if you use your own car for business, it has nothing to do with your company car - you cannot claim the 45/25p for mileage done in your company car.
Don't forget the benefit may be £6000 but it only costs you this x your highest tax rate 20/40/50% and if it was in your tax code you've already paid it!0 -
I have a K code. The whole thing is a mess. I have owed HMRC tax every year for the last 8 years. I dont understand why they dont take out the right amount.
