Can I sell fake GHDs just as straightners - no brand?

    For the bandwagon legal eagles. The op was sold these as GHD and she has clarified they have the GHD logo, despite the fact GHD have confirmed them as fake, some still fail to see the resell problem.

    If you sell or knowingly pass on an item which purports to be something it isn't (ie a counterfeit) then you too are guilty of selling/dealing in counterfeit items. This is aside of any morals anyone may have.

    If the op sells this item as anything she will be guilty of selling a counterfeit item REGARDLESS of how she describes it.

    I trust this now clarifies for those TSFE.

    About 18 months ago I bought MS Office Pro from a local computer shop - £30 cheaper than the RRP, and roughly the same as many online retailers.
    Turns out it was a fake - and a VERY good fake at that - it even had the feathered portal in the security strip.

    When I contacted Microsoft about it, I sent it back to their Reading HQ along with proof of purchase and a signed declaration and they replaced it with a genuine edition. Not sure if GHD do something similar?

    Fakes are fakes, bin them, write it off to experience!

    Genuine GHDs have a code under the hologram and another on the sticker on the cable. They will register on the GHD website if they're real, thats how I found out they were fake. Other than that there's nothing to give them away.

    http://www.articlesbase.com/shopping-articles/how-to-spot-fake-ghd-hair-straighteners-832399.html and this shows what to look for - although it's only any good when you've actually got the product in your hand, so wouldn't have been any good for OP.

    Devil's advocate: What happens if the OP erases the GHD logo from them somehow?

    Btw, could we have a citation for this law? Not that I don't believe you, but it'd be helpful to see the exact wording of the statute/the exact context of the case law.
