Can I sell fake GHDs just as straightners - no brand?

My GHDs broke at the end of June and I went onto the (genuine) ghd site to look for new ones. When I went back later on to buy them I went to a different site, but didn't realise it. It looked more or less exactly like the site I'd been on earlier and I didn't realise my mistake until they came............ from China!

Now, they look like the real deal but when I tried to register them on the GHD website it didn't work. I was a bit confused and called them to see if I was putting the wrong codes in or something but they confirmed they were fake. I managed to get back to the website through the confirmation email (which I have to admit I hadn't paid much attention too) but couldn't find a contact address or email, just a broken link. All over the site it says Genuine GHD site....... Aaargh!!

They work fine, but aren't as good as my old GHDs so I've bought a real pair (lol definitely real this time!) and wondered if I'm allowed to sell the other ones on ebay if I make a big deal of pointing out that they're fake? If I don't mention GHD in the title or in the listing except to say that they are not the genuine branded straightners that they look like?

  • So palming them off on someone else is ok?

    Selling fakes is unlawful. If you believe they are fakes, you should not be selling them, but exposing the site which sold them to you. How many other people would you like to fall for the same scam?

    Telling half the story is as bad as telling the lie. If you know they are fakes, you have had this confirmed, then you should do the lawful and decent thing and dispose of them, in the bin.
  • I've reported the site (by forwarding the email and a scan of the receipt) to GHD (although 2 months later it's still not on their 'fakes' list) in the hope that others wouldn't have the same problem.

    I wasn't trying to 'palm them off', they work fine - just not as well on my curly hair as my previous straightners. I wasn't trying to decieve anyone (unlike many sellers on ebay) I just genuinely wondered if there was a legitimate way to sell them as plain straightners to help recoup some of the money from buying 2 sets of straightners in as many months.

    It's not a problem to just keep them as spares, I just wondered if it was something you could do. :)

    Fake is FAKE. Selling fakes is unlawful. Even if you try to sell them as fakes.

    So perhaps a photo of the straighteners would be avoiding this?

    I am sorry OP but you KNOW they are FAKES. Whatever way you want to butter it up, you cannot sell them lawfully.

    Bin them.

  • I'm not going to bin them, I can't afford to put that amount of money in the bin.
    However, now that I've had it clarified, I won't be selling them either. They can go in the cupboard and be kept for emergencies or holidays.

    To be fair, you're making it sound like I was intending to con people. It was a genuine question with no malice or badness involved. You see so many obvious fakes on ebay (disguised or otherwise) that I just wondered if there was a rule I was unaware off. I knew you couldn't sell fakes, but I wasn't sure if you could sell a fake AS a fake.

    I'm happy with your response as it gave me the answer to what I asked (can I or can't I) and I appreciate you taking the time to give your input. :)

There's a link that says (something like) email us - but the link doesn't work, you can't click on it and I wouldn't presume to just send them to the address on the receipt/shipping form without being able to contact someone 1st. :(

  • I knew you couldn't sell fakes, but I wasn't sure if you could sell a fake AS a fake.

    Sorry to be hard, but that is a contradiction.

    You cannot sell fakes. End of.

    I appreciate you have lost money but at the end of the day, your fakes, could start a fire or something worse. The best advise is to throw them away.

    This is probably too late now - but if you've got confirmation from GHD that they are fake, then you could've done an Ebay dispute and paypal would have refunded your money, and you could keep the item.

    Just worth a try - depending on when you actually bought them....

    Thanks, but I didn't buy them from ebay, I bought them online from a site which I thought was the GHD site. :) Thanks though. x
