    The law states that if an item or service is advertised at the wrong price, the seller or retailer is not contractually obliged to sell at that price, providing that the error is brought to the attention of the customer/consumer, they are notified of the correct price and given the chance to leave the purchase. A contract is only legally formed and sealed when goods or services are exchanged for money or a legal form of tender. This means in practice that had you bought the items for 1p and the sales assistant, having realised that this did not seem correct, could not reverse the transaction. They can ask you accept a refund (as goodwill) but cannot legally enforce this. The sales assistant is perfectly entitled to request clarification from supervisors/managers etc and can take time to check details etc with head office providing that they have not accepted your money. If Tesco is aware that there is a glitch then it is their responsibility to ensure it's chain of command and staff are aware of the issue and that reasonable steps are taken to avoid embarrassment at checkouts etc.

    Attempting to take advantage of a glitch is in no way illegal in this instance and therefore whilst the staff at Tesco may not be pleased that items have been purchased at 1p or are scanning at that price is not the fault of the consumer. Refusal of sale is their right but abuse and harrassment of customers is not. I would go back to the store and ask to see the store manager and ask which law you broke, why the police are not involved and why a nationwide ban with CCTV is necessary. Failing that, I would write to the store, copying in the Head Office and explain the situation and their treatment of you and state that you expect a detailed reply within 21 days. I would also contact Citizens Advice Bureau.

    I will no longer be doing any regular shopping at tescos, this isn't the first time I've had problems with them. The staff at my usual store are so rude too, the online ordering staff usually block the aisles and assume they have right of way, even if it means crashing into the trolley which my 18month old son is sitting in.
    I think Martin should consider not including this in the weekly email as it would seem a lot of people could end up being treated quite badly by tesco staff.

    Yet another moneysaver was told over the phone by CS that they should've been allowed to buy the 1p items!?!?! No consistency at all!!!

    Thanks for that :) I guess this comes down to morals, and therefore it will be difficult to nail a definite rule here. It does begin to beg the question morally of how right any of this bargain sharing?! I have spent £2.70 today in Tescos on impulse buys whilst hunting for 1p items, I know its a modest sum but its these deals and glitches that keep me going back to Tescos and often buying much more than I had on a shopping list!!

    it makes me so mad because they regularly get my home delivery order wrong and I have to call them at my cost to get their mistakes corrected then.
  • another thing i have been stewing on is the comment they made that it is illegal for them to sell said 1p items so saying that should tesco now not be taken to court via the authorities that deal with these matters as they are breaking their own rules and the law by the sounds of it.
    My poor 15 yr old daughter broke her wrist i 5:eek: places tonight poor little mite was screaming in agony, all casted temp now and fingers crossed no surgery needed to fix.

    exactly right the 1p items should be treated as a loss leader as in 2 days of searching for 1p items me and oh have spent £30.00 on other goods we would not otherwise have bought as we wouldnt have gone to t;s in first place.

    Oh I know allll about Tesco, I would not shop there if it was not for the clubcard deals and glitches, and I guess maybe one day when I'm earning enough I will shop in lovely Deli's instead :D

    Dear Tesco

    If you do not wish your customers to buy your discontinued lines for 1p set your system to change the price to £999 when it is to be sent back therefore saving you money time and the goodwill of your customers as I guarantee we will not buy your tat that even you don't want at at that price. Either that or ensure your sales staff and your customer service staff understand consumer law and treat your customers with some bloody respect instead of the cash cows you think they are.

    (where I work (not tesco) our DC'd items are sold to us for £1 and if you think the general public are not aware of this practice you are mistaken. Are you really going to RTD a few pairs of socks that have been de-listed. I doubt it.)
