I am a new user of this site, but have been following it for some time.
No I have not received my Dyson, No I have not had a refund.
I have had the usual initial email re bank transfer, which stupidly I did. I Have had two emails since. The first on the 6th January ( I ordered on the 1st) saying he would get accountants to confirm payment and give me ETA for Dyson. After that I sent a letter asking (13th January) for a refund. I sent this letter recordered delivery and give him the required 30 days. The recordered delivery was received and signed by a **!!!!. On the 23 January I received a third email saying "will arrange refund".
    Nothing since.
I have been in touch with the local Trading Standards Office. who has advised me in all my actions. They also said that Suffolk TSO was "monitoring" the situation.
I have reported this to Action Fraud, Have been in touch with Dyson who were very interested and told me they have never supplied equipment to Utopia Consotium.
I have tried ringing him on the land line and mobile. I tried sending a fax. all to no avail. sent a further letter and sent numerous emails.
I have not reported to the Police. Do not know if it would help.
My next step, according to the TSO is to take court action.
Because this is a limited company. Does anyone here think this is worthwhile. From what I gather with regard to company law. I quote" most of time people who own Limited Companies are not liable for its Corporate Debts"
As I would not think he had any Company assets, No warehouse, no stock, am I just throwing good money, after bad.
This question is really the reason I am writing this.
As someone else here has ssid, this forum has helped me a lot, as I do not feel alone in this. Thanks. J
  • Forgot to say that I have reported to Watchdog but have not heard anything from them.
  • For the attention of all Utopia Consortium limited customers.

Please be advised that Suffolk Trading Standards have been in discussion with Utopia Consortium limited since the beginning of 2011 following complaints regarding their supply of Dyson vacuum cleaners.

As a result, on the 16th of March Utopia Consortium Ltd agreed to stop taking new orders for Dyson vacuum cleaners and to issue refunds to all outstanding customers that have paid but not received a machine.

In view of the amount of refunds that need to be made we have requested that Utopia Consortium issue refunds to those customers that ordered Dyson cleaners first and we have been receiving updated lists of these refunds on a regular basis to allow us to monitor the situation.

Currently our checks indicate that refunds are being made, however due to problems with Utopia’s bank the process is taking longer than expected. As such if outstanding customers have not received a refund by the 1st of April 2011 please contact Suffolk Trading Standards and we will liaise directly with Utopia to investigate why this is the case.

We will be following this process closely, and the company will continue to be monitored once this situation has been resolved.

Thank you Roman42 for letting everyone know about the bounced cheque.

Is this the next series of calamities to befall victims of Mr Ensinger and Utopia?

I encourage all posters to please let others know whether or not they have received full refunds or just rubber cheques. We need to monitor this situation.

Interesting to see the post from Suffolk Trading Standards!!!

Keep the pressure on everybody. Don't let this man get away with it.

My cheque did clear today, so some hope for others still waiting.

Thanks to Sufolk Trading Standards for helping to sort this out for me, although personally I think the authorities are not going anywhere near far enough and should be taking steps to close this [TEXT DELETED BY FORUM TEAM] company down.

The amazing thing is that Utopia still took orders for Dysons up to 16th March. This means that there are many many non-net savvy people out there who have been subject to this poor practice.

I don't know how Ensinger sleeps at night knowing all the angst and grief he is causing?

I have today added my name to Suffolk Trading Standard's database. I had a positive conversation with their representative and they are working with Utopia to resolve the situation for all the people who did not have their orders fullfilled. Fingers Crossed.:j . Many thanks to this website.
  • Spoken with Trading Standards and a very helpful chap has put me on the list for refunds, if I haven't received the refund by 1 April to contact them again. Utopia are working with them to refund people!!

I have just had my cheque returned by my bank today! These robbers may have stopped operating, but they are still affecting the lives of so many people. I have today escalated my court summons, but don't hold out much hope. I just cannot afford to say goodbye to such (for me) a large amount of money without giving it all I've got
