I truly sympathise with the stress you have gone through, please PM me if you need any advice I will do what I can to help. I did look up the company you mentioned, but felt that I should not post anything because I already have enough on my plate.
They know who I am, they just can't do a thing to stop me posting here, as long as I behave reasonably. But they have done a lot to post fake reviews about their companies (which I have complained about and had removed), and they do all that they can to remove genuine negative posts from review websites, but have failed miserably on e.g. this forum and others like the Consumer Action Group website. They do not hesitate to "muscle" hosting companies with absurd legal threats if they refuse to remove negative reviews.
By "shill" I mean persons working for the company, like that bottom-feeder "reclaimingfairy" who post fake positive reviews to boost the image of the company.
Update: Tribunal Action website is dead, and the Ministry of Justice have issued a "variation" in respect of what they are and aren't allowed to do:

According to this chap, they have lost their license to process ET1 forms on behalf of clients:

Interesting - this lot seem to be starting up again.
I just had a call from someone claiming to be from Action Direct on 08450405921on my mobile. (Quite where they had my name and number from is rather curious)
Once I'd determined it wasn't a genuine call I adopted my normal stance of silence. (If you don't reply they can't argue back and you can listen to them going 'hello ... hello' a few times before they give up)IANAL etc.0 -
Hi, I realise all above posts are old but this company is still claiming PPI for peeps as my Mum and Dad signed up with them last July (July 2014). They have heard nothing since. Please can you advise if we can pursue the claim further (i.e. Make them pay up!) or if my parents can cancel their "contract" with Action Direct?0

They still exist according to the claims regulation register.

I was like a few others on here bombarded with calls about PPI, I told them that I had debts on my previous accounts and eventually went bankrupt after redundancy back in 2003. They said none of this mattered as I could still claim back ppi. So eventually I decided to take their word for it.
I was awarded a sum from Natwest and thought everything was ok, until I recieved a letter a month later stating that my award had been passed to Natwest's Debt management office, and that I may not receive any of it as it would be used to pay off arrears, which it has been.
In between all of this I have had calls from Action Direct asking for money possibly ten times a day on average on multiple phone numbers, and one final demand letter. They told me that even if the money was used to pay off arrears with natwest, that I would still have to pay Action Direct their £700+ slice of it.
How can I pay anything to them when I haven't even received anything personally. Action Direct told me at the beginning that I could still claim despite my previous debts and bankruptcy.
I would have to be a madman to go ahead with this if I knew I would still have to pay them without even receiving any of the PPI myself, if it came to that.
I feel I have been conned by this bunch of con artists, and really don't know what to do as I cannot pay them £700+ , as I have been ill for three years now and only on ESA benefits.
please could you offer any advice

Their terms and conditions make it clear that even if your PPI complaint is won and money is offset their fee still applies

I wish to make a FORMAL COMPLAINT against Action Direct UK that it bombarded me with telephone calls to persuade me to permit it to pursue a complaint about Payment Protection Insurance. I have now learned that your regulator does not allow you to use high pressure sales tactics. Please explain why you ignored this rule.
When I told you that I had been made bankrupt you told me that I could make a claim anyway. However, you failed to explain to me that any redress I received would be passed to my creditors in that bankruptcy but I would receive nothiny but that you would still demand payment from me.
I put it to you that Action Direct UK is in breach of the rules of its regulator because it lacks integrity and knowingly and dishonestly made a misleading statement in order to make a gain for itself.
Since that time, despite knowing that you are in breach of the rules of your regulator, you have persistently harassed me for payment for a service that, had you properly complied with those rules, I would never have agreed to.
I demand
1) That you IMMEDIATELY stop telephoning me and hence forth commuinicate only in writing.
2) That you confirm that no payment is due to you.
3) You properly compensate me for the distress and inconvenience your harassment has caused me.
If you fail to respond to my complaint to my complete satisfaction, I shall refer the matter to the Legal Ombudsman.
In the meantime, a copy of this complaint is being sent to your regulator.0 -

Very unfortunately not. They are banned from claiming that they are in any way likely to get a better result than if you do it yourself, which is not the same thing.
If the OP actually signed a copy of those terms and conditions then it starts to become a bit more difficult. However, on the basis that CMCs often accuse banks of misselling by burying important details in small print, I don't see why the same logic wouldn't apply to them. A court may uphold the contract, however, I like to think a consumer complaints ombudsman (Legal, not FOS) would find in the OP's favour. Action Direct are unlikely to be able to produce a call recording which exonerates them and on a common sense basis who on earth would appoint them knowing they would have to pay them but would not receive any of whatever redress may be awarded.0 -

This advice should have been given before the claimant signed up for the CMC’s services.
