Action-direct

Options
Hi. We were recently contacted out of the blue by Action-direct.co.uk , offering to pursue any PPI claim they felt we may have. After some discussion, they decided we probably have a claim against my mortgage company. The mortgage was paid off a year or so ago when I sold the house. Action-direct took an initial £95 fee to asses the claim, and have now decided they feel it's worth pursuing. They have sent me the paperwork they need filling in, and it says in there that they take 25% of any monies they get! Also, when I rang to ask if I get my initial fee back in the event the claim is unsuccessful they were very vague, saying they don't think it will be! How can they know if I was miss-sold the PPI until they contact the company involved? I took out the PPI knowingly, as I was recommended to do so - how is that miss-selling? I'm very suspicious of the whole thing, and need advice! Especially as they want my card details again, so they can take the 25% in the event I don't pay them fast enough!!

    Hi There

I would keep right away from this company and any other that makes these claims. Usually it is difficult to claim back protection on a mortgage as it is needed in some degree to cover your mortgage.

Hopefully Dunstonh will reply to your message as this is his field.

With MPPI, its fairly easy to know if you were mis-sold or not. If its single premium then its nearly always considered a mis-sale. Or if you were ineligible at point of application. However, if you are eligible and paying monthly then its not a mis-sale.

If its monthly payment and you had a financial need for it then its not.

You are right to be. A lot of these claims companies tell porkies to get you to pay them more. A lot of their complaints are template letter based and hope the adviser/broker has poor admin or missing documentation that will allow them to get lucky. This is what happened with endowments. If you took 1000 typical endowment complaints you would find around 225 would be result in redress. 200 of those were not upheld but still paid out because of missing or incomplete documentation. However, most financial companies learnt from that and are far better with their documentation nowadays.

  • Hi, and thanks for these replies, though they do kinda confirm my worries! So, what about the £95 they've already had from me - can I get it back?

  • Anyone thinking of using Action Direct DON'T.
Totally unprofessional company they bomb bard you with phone calls then unless you chase them they sit on your money It took me 8 months to get some sort of answer from them after lying about various parts of my claim.
After persuading me that I would not be charged for one of my claims after I repeatedly told them that there was no mis sold PPI on that claim they then refused to return my money.

I am in the process of taking further legal action against Action Direct.
  • Guys,

I had to reply to this thread as I am using the company that this thread refers to for a few of my mis sold payment protection claims.
A few weeks ago I had a letter in the post to advise me that I had won back £11,245.31 from Legal & General in regards to my Mortgage protection, I signed the acceptance and sent it back to them and I have been advised that I can expect my money in the next 30 days........I was literally doing back flips in my front room.:j
I have also received a letter this week to say that we have won £2289.01 from my Lloyds Credit Card as well, I still have a HSBC Loan & and AA Loan to go yet.:rotfl:
I have to say that this company (for me) has done everything that it promised to do and that the dealings I have had with them they have always been pleasent and efficient.
I will recommend them to everyone who will listen especially as their work has just paid for my longed for extension that my husband has always said we cant afford ;) :T
All I can say, Reclaiming_Fairy, is that you must have been one of the lucky ones...
I took out a claim with Action Direct approximately 11 months ago, after being bombarded with calls by their sales team (as reported by other correspondants). Finally relenting to discuss my financial affairs with them , I was informed that "most claimants" in similar cases (what percentage defines "most claimants"? 95%? 75%? 52%?) had won settlements "in the region" of £1200 after deduction of AD's fees, So, blatantly ignoring the old adage "If it sounds too good to be true, it probably is!", I agreed for them to take on my claim for PPI against an old loan I had with Lloyds TSB; First mistake! Immediately charged £95 to have my case taken on! KER_CHING!! Very minimal contact/communication with AD over the ensuing 11 months aside from a couple of forms from the FSO Ombudsman to be completed & returned... Time passes, still no word on my settlement... Then reported on the news that the big High Street banks had effectively held up their hands & said "It's a fair cop" & admitted that they had mis-sold PPI in some cases & that out of court settlements were due - but still no word from AD! Then, 3 days ago (12/7/11) a call from them to let me know that Lloyds TSB had agreed to settle, for the princely sum of... £608!! Now,to me that's not just not "in the region" of £1200, it's on a completely different continent! And as if this wasn't enough, this was the gross figure, from which they were already demanding settlement of their fees of some £180 (this was immediately they had informend me of my paltry "settlement", even before the amount had been credited to my bank account, for which I am still waiting!). I would have expected them to have deducted their fees from the settlement before releasing the monies due, rather than paying the amount in full & then demanding payment of their fees back! So, after deduction of their fees (and including the initial £95 for them to take on my claim) I'm left with the staggering fortune of £333 (most of which is going to be eaten by my bank overdraft!). When all's said & done, I'll be lucky if I turn any profit from this debacle!
So in closing I would echo what most others (by which I mean a good 90% of contributors) have said; If you're thinking of using Action Direct - DONT!!!!
