    I empathise with the seller to be honest.

    I sell a lot of items but I dont offer postal insurance becuase its a pain in the butt. The if items do go missing sellers have free reign to jus click one button and the money they paid is withdrawn from us buyers accounts.

    Im a powerseller too and intuition tells me with 6000 feedbacks he sells small electrical items, phone covers etc? am i right?

    If you opted not to take postal insurance then as a seller he will not have proof of postage reciept or a tracking code. So in the eyes of paypal for some stupid reason you will be given the benefit of the doubt.

    Is it really fair that in opting not to pay insurance than the seller is thus out of pocket?

    That's ridiculous, if the seller had half a brain he'd have got FREE proof of posting which would have insured the item up to £32. With 6000 feedback he should know better.

    But the seller need not be out of pocket if he actually posted the items and got a proof of postage. He would claim from Royal Mail. Why should the buyer pay extra for insurance when the seller can claim without one anyway :confused: ??

    The insurance and tracking with postage is for the SELLERS benefit, not the buyers.

    More fool any powerseller who sends their items normal post.

    How is it a stupid reason for Paypal to refund the buyer if the seller cannot prove they have sent the item and it has been delivered? :confused:

    Sellers should not have insurance/tracking as an option, if they don't want to lose out in the long run, they should insist the buyer picks up this tab.

    Just received this email from grumpy seller:

    "I wondered why you asked for proof of posting, it is not worth the paper it is written on the same as, can you prove it has not been delivered?. Why should we bare the full cost of the lost item? Doing claimbacks through paypal is pure theft our terms are clearly stated in the listing, as you refused the insurance delivery is at your risk, continuing the claim will result in negative feedback and 2 non payment strikes, when you receive 3 non payment strikes in total you are automatically, suspended from ebay."

    Since I paid immediately for the goods, and have not received anything, can this seller issue a non payment complaint? :confused:

    Not that I'd stop the chargeback, of course. Can I issue a non-perfoming seller complaint as well?

    Proof of posting is worth £32 insurance to HIM. Postal insurance protects him not you, so its not for you to decide if it is to be paid or not. He should bare the ENTIRE cost because its a legal requirement that he ensures that the item reaches you.

    Always decline insurance if its optional and you can pay via Paypal. Its the sellers problem under Paypal T&C to make sure the goods reach you - and that they can prove it.

    Their terms on the listing are subject to Paypals terms if they accept Paypal which take priority and clearly say that items must be sent by a postal service with online tracking - whatever it says in the listing.

    Tell him that you will appeal any non payment strikes with Ebay and that you will win as you can prove that you have made the original payment. This would count as one non payment strike anyway as its one transaction until ebay remove it when you appeal it.

    Tell them that you will leave them negative feedback if the refund isnt completed to your satisfaction immediately. Negative feedbacks - especially for items not delivered - will cost them as a seller far more than you as a buyer.

    DO NOT accept 50:50 - the post office are working for him not you and its up to him to recover any losses via the proof of posting or insurance that he should have obtained.

    Paypal requires a tracking code, particualr for international items, and the idiots who cant speak nor interpret the english language correctly on the resolution centre dont understand what a royal mail reciept looks like.

    Ive sold many things to the rest of Europe and on so many ocasions, months later, the buyers have claimed not to have received the items and like I say, the paypal team appear to have IQ's of around 30 when processing claims.

    Im aware that items under 32 quid can be claimed back but its the seller who has to fill in all the forms and wait several weeks to hear back. So by offering discounted postage without insurance its a bit rich then asking for it if somethng happens.

    Problem with the big 6000 plus powerseller guys is that they dont care because they sell so much. People get sucked in by the high feedback number but maybe dont realise 1 in 15 of their items are reported unreceived.

    NO it cant. Only feedback extortion can be reported. ie saying something like 'I will only do xyz if you leave me good feedback first.'

    I had a couple of idiot non paying bidders this week but you cant leave negative incase they do the same back.

    He probably will be able to leave you a Non-Paying bidder strike, but you should then be able to appeal it successfully, as you will have the Paypal proof of payment.

    Unfortunately I'm not sure you would be able to do anything about a neg, apart from reply calmly and factually explaining the situation.
