Reassurance please!

Just received this email from grumpy seller:

"I wondered why you asked for proof of posting, it is not worth the paper it is written on the same as, can you prove it has not been delivered?. Why should we bare the full cost of the lost item? Doing claimbacks through paypal is pure theft our terms are clearly stated in the listing, as you refused the insurance delivery is at your risk, continuing the claim will result in negative feedback and 2 non payment strikes, when you receive 3 non payment strikes in total you are automatically, suspended from ebay."

Since I paid immediately for the goods, and have not received anything, can this seller issue a non payment complaint? :confused:

Not that I'd stop the chargeback, of course. Can I issue a non-perfoming seller complaint as well?

I've never had to before.... :rolleyes:

    Of course he can't issue a non-payment strike - I assume that you paid via Paypal or some other traceable method (cheque?), not cash through the post? I don't understand the part about 2 non-payment strikes, unless you bought 2 separate items from him and are claiming to not have received either............

    How long is it since you bought them, what's his f/b like, how long has he been trading?

  • Bought 2 items, supposedly sent together. Nothing received - I did select normal first class post, but seller cannot even supply proof of posting. I'd probably be happy to go 50/50 on the loss if this was the case.

    He's a powerseller, 6000+ feedback, 99.7%.

    Second item ended 19:33:14 27/8/06.

    Payment made 20:09:13 27/8/06.

    I don't think 35 minutes 59 seconds is an especially long time to wait for payment? :rolleyes:

    Do not listen to this guy. Delivery is the sole responsibility of the seller and nothing to do with the buyer. He's just trying to bully you. Report him to Ebay for feedback blackmail.

    He can technically file for NPB if he refunds you, but since there is proof of your PP transaction there is nothing to be gained by this. Although, since this is not the first time I have heard about this I wonder if there isn't something going on there. Can Ebay NPB you if you have paid via PP? Anyone?

    You can definitely do the NPS.

    I can see how newbies and even regulars could be swayed by his 'arguments' to cancel chargebacks. I'm starting to wonder myself sometimes!

    As a matter of interest, does he claim to have sent the items as 1 parcel or 2?;)

    No no no no no. You are not liable for anything. They quote p&p, you pay, you wait for item to arrive. If the seller can afford to let expensive items go by 1st class that's his problem. If he can afford not to get proof of posting that's his problem. Of course you can be nice to nice people, but not lying so and sos. Grr.

    A seller can give you a non payment strike for each item you bought from him, but....
    You need strikes from three different sellers to get suspended.
    Like feedback, his strikes would only count as one.

    80 characters on each.

    I set up a buying account exactly for that reason. I don't care about the feedback. But some sellers are getting more nasty...
