  • Thanks for the advice in the article. I've a broken product and used the information given to help get a refund. I had googled and found some other articles but this was the best and covered the ins and outs of my particular circumstances. The company initially quoted their policy and refused to refund me but I said I wasn't applying under their policy but under the legislation, and I used some of the other advice too. They agreed to a full refund and then agreed to cover return postage - initially they wanted me to pay international postage to the EU.
  • I read that accommodation within a particular timeframe isn't covered under one's statutory rights to cancel and obtain a refund when contracting for a service. What happens if the accommodation isn't as was described on the On-line booking site? For instance, if a double bed turns out to be a large single.

    Does this come under the reasonable care and skill rule and if so how might one best proceed?

    If you read this thread from the start it will answer that question. Don't skip bits or think they don't matter, you need to read the entire thing.

    Holiday rentals are not exempt from your consumer rights. However the right to cancel does not apply - this is a right given to most (but not all) contracts entered into via distance or away from the traders own premises (ie in your own home) under the Consumer Contract (Information, Cancellation & Additional Charges) Regulations 2013.

    If the accommodation didn't meet its description then you'd be looking at claiming a refund (most likely partial unless it was exceptionally bad) under the Consumer Rights Act instead.

    However be aware that the website/hotel you book via may not be a uk one. Anywhere in the EU should be similar in law if not the exact same - as thats where all our consumer protection comes from, the EU. But outwith the EU the law could be very different.

  • I've written out a complaint to a company two days ago now but I am too scared to send it. I'd prefer it sent as early as possible so this doesn't drag on and to make it sooner that I can send everything to the Ombudsman but I am worried that on receiving the complaint the company will just cancel my order (which for peace of mind going forward I really would like to receive) and close my account as a way for them to avoid dealing with the problem.

    Is that a possibility?
