Please help DLA renewal turned down

    I was under the impression that the criteria for ESA & DLA were different. If this is right how could DLA be refused because of an ESA medical (which are questionable at best).

    You are correct - the criteria is different. Therefore, you can be entitled to one but not the other.

  • I thought DLA was for help with your needs and care and ESA is what you got when SSP had run out. How would one affect the the other?

    Some of the criteria are similar. IE, there's criteria on both about walking difficulties.

  • But should somebodys DLA be refused because of an ESA medical as there are so many people appealing the ESA medical decisions. At least DLA decision makers take into account your Doctors and Consultants reports where as ESA decision makers overide anything they may say..
  • From what i can gather no medical evidence was submitted by the op and the dession maker has used possibly the only medicle report avalible which is the esa medical.

    Personaly i think considering the said reoport is 15 months old i think that is poor practice on their behalf and his gp or other doctor should have been contacted for an up to date report.

    The op stated they where awarded esa aswell which would say they do have some sort of disablity, it seems very harsh they have dropped you from high rate on both accounts to nothing at all.

    I also had a poor experiance regarding the esa medical, i was shocked at some of the answers on the report, the lady was very clever in how she asked me ceartain questions to get specific answers from me and it only made sense when i actualy read the report. :mad:

    Also can anybody clear up weather they are allowed to use such an old report? that seems very unfair to me 15 months is such a long time, how on earth do they justify such an old report without bothering to contact the claiments GP for an up to date report? im sure they are not allowed to use a 10 year old report so there must be a cut of line i always thought it was 6 months.

    Recived a letter today stating they where going to look at my claim again, it said please send in any forms we have sent you and send them back, there was no forms so i guess they are reffering to any further evidence i want to add?

    it says it will take up to 11 weeks, slight concern now is somebody will look at is asap before they have recived my letter and also my reports.

    not sure weather to send the letter diagreeing with the dession before i get my gps report or not now, i would have liked to have waited untill i had my gps report so i could reffer to quotes from it in my letter.

    This is what happened to me, they reconsidered mine before the date they gave me for returning additional info which then forced it to an appeal. They were totally unsympathetic to the fact that their actions had caused this.

    omg! thats exatcly what i dont want how long after you rang up did they make the dession again? :o
