This is the fantasy law as PPC drones like Perky would like, not the law as it is. The fact is that in most if not all cases involving private parking it will be difficult to avoid the rules on unlawful penalties. This is in addition to huge issues on driver ID (which the new law will not resolve) and formation of contract in the first place.
This is why litigation is just a cottage industry for PPCs and the vast majority of cases taken fail. It is just not feasible to conduct large scale litigation and emerge with any profit element. The BPA know it, the major PPCs know it, the only parties who do not seem to be a few trivial operators with more than a few axes to grind. It's just like the "what if someone parks on my drive" fantasy - maybe interesting for a nanosecond but not real life.0 -

I don't remember anything on the signs in the car park (there weren't many of them) saying that you could park there for £100 for three hours.

Let's not lose sight of the fact that "You can't leave the site on foot" car parks are relatively uncommon. And that is what the "£50 for 8 hours if you don't visit my shop" condition is intended to deter. Again, I can't recall one.
The closest one I can think of is Gardiner Haskins in Bristol. It's free for 1 hour, if you get your ticket stamped in the store, and no purchase is necessary. Spend over £10 and you get 3 hours free. For the chargeable rates, click on this ...

But you can leave the site on foot. And it's within walking distance of the city's new main shopping centre. Yet, I've always been able to find a space. And, it seems to work for the store.

Minnow companies winning what are usually default or set up/cherry picked cases will never impress anyone. Only idiots like Perky have the time to be haring around the country "winning" at the most beer money.
Parking Eye tried litigation and now wish that they had not, having had their !!!! handed to them by the Judge. Even if they had won it would not have set a precedent and they would have to win the majority of other cases to justify the investment. The numbers do not stack up.
Let's see about keeper liability. There is a clear coach and horses issue that I can see that will fatally undermine this, but naturally now is not the time. Even if there were not it would still require large scale litigation and there is no reason to think this will be any more likely, given the known uncertainty of litigation and given that many cases have gone against PPCs even when the defendant admitted to being the driver. Morons like Perky will go on trying to prove a point but nobody will listen.
I would say on the statistics I have seen that the rate of PPC court failure is about 95% and we cannot say of the remaining 5% how many are genuine cases and remembering that the rate of cases taken is somewhere around 1% or less..0 -

I can think of one, there is a nearby Waitrose who has a barrier controlled car-park, it's £5 for 2 hours parking but if you spend £5 in the store parking is free (you show your receipt to the Waitrose employee on the barrier), so the option is there to park and not shop in store, but it's costly compared to the council car-park which the "escape" lane ends up in.0 -
Only very foolish PPC waste time with courts, around 60% of scam victims pay straight up as they fall for the impersonation of authority scam.
A ppc knows that given those rates, he could have slapped dozens of fake tickets on cars in the time spent at court on 1, so over all it is not worth their time bothering when they could be hiding in a Silver 4x4 truck waiting for the sick, elderly, infirm and generally stupid looking.Hi, we’ve had to remove your signature. £5 for 2 hours is still a lot less that the £50 for 8 hours example. But, the latter is so high, because it's supposed to be a deterrent.
