I'm slowly making my way through all the latest posts on this thread (about 3 new pages since I last opened this thread).... and some great contributions.
This landlord, after how she went about getting Carmen Nobre to leave her home, is still campaigning, having "looked at it from all sides" (lol).
Special thanks to lily (great chronology post + other contributions) and to ariarnia and pinksleepybear for engaging The Argus web-story person in defence of logical positions by email.
BTW - Suzy Butler, her facebook posting about charging a £15 per day late fee... in high-definition. I used a video record program to record what she had posted on facebook about that. High definition.
You can even click a button (see the big red arrow) to expand the video - and see it perfectly. Whilst video recording I had the foresight to click for "view-page-info" in my browser, to absolutely prove the source was facebook.com in the video.. and Suzy Carlita Butler's facebook account.

Do the 2 months rent arrears coincide with when the landlord returned from Peru and possibly tried to regain possession ?
Is there anything written in the AST which says tenant was supposed to leave after 2months ?
The tenant may have been as confused as the landlord about her rights & responsibilities, where she stood, whether she should still pay rent when landlord was turning up every 5 minutes demanding she leave.0 -

So she has not got a first clue about the function on a Section 21 notice.
The section 8 is the accelarted way to get your home back.
Not if you have correctly issued a valid section 21 notice. And anyway, if you want to accelarate the case, issue the S8 as soon as the tenant is two months in arrears.
My child starts school next week. That was my priority.

In two days she has been FORCED to live in a tent.
10th August: Campaign mentioned on jeremypdunmore's twitter.
10th August: Suzy on BBC South East Today, Tessa appears too.
11th August: Suzy is on GMTV. w
11th August: Suzy is on ITV news 6.30pm.
12th August: Suzy is on GMTV, for the follow up report.
12th August: Suzy is on Radio 5.
13th August: Suzy is on GMTV, for the second follow up report, live on the sofa.
13th August: Tenant moves out, landlord moves in.
13th August: ITV Meridian Tonight reporting Suzy is back in the house.

In answer to "where did she sleep"
At her mothers in Newhaven. Its quite a big house, it seems. Although, I may be getting this confused with where she stayed when she got back from Spain. Either way it was for a period of 3 weeks)

I seem to recall from the open facebook profile that it was apparent there were still posts to suggest she was in Spain late June, how much longer after that I do not know.
Re the tent.
Yes, The Argus reported on 7 August that police weere called to the propert on Thursday (5 August) to assist a homeowner going into her property to retrieve a tent.
By 13 August, she was back in her house. That we are expected to believe she was slumming it in a tent in a friends back garden for a period less than people to chose to go on camping holidays for, and probably had much better facilities while doing so, is quite frankly ludicrously offensive.
"2-3 nights a week in the tent" when interviewed by GMTV - that story appeared on 11 August so we can assume safely that it was filmed latest 10th of August. 2-3 nights a week in a tent you've had for 5 days?

She also said in one of the interviews (I think it was the first GMTV one) that she was planning on sleeping in the tent in order to spend some quality time with her son, as up until then they'd been staying in different friends' houses because nobody could put them both up...? How much extra space does a four year old take up !!!!!!?
As for the school thing - I just checked the Brighton & Hove Admissions Guide and she would have submitted her preference form by 5th February and received confirmation of a school place by 5th May (IF she followed correct procedure of course!) so I don't think the school thing comes into it.
Unless someone had grassed her up for falsely claiming to live within catchment/close to the school of course... A suspicious mind might raise an eyebrow at the tenancy start date being conveniently one day after the admissions deadline...0 -
So she was living in the property when she submitted her preference the deadline was the day before the tenant started and she was out of it and on the way to Peru?0

That's about the gist of it, yes.
According to the guidelines, you only have to notify them of a change of address if it occurs before the submission deadline for preference forms, or if you want them to use your new address when deciding which school place you are allocated. But it then goes on to sayIf a family has a residence in Brighton & Hove and temporarily lives elsewhere (for example, a temporary job out-of-area, or abroad), the School Admissions Team may seek evidence of residence at both addresses, and evidence that you will be returning to the area.0
