    There is no question of a prosecution in this case, and in terms of an internal compliance investigation, the civil definition would still apply.

    If the DWP suspect fraud (and nowhere has it been stated that they do), the same burden of proof with regards their status as a couple will apply. The criminal burden will apply to proving fraud i.e. that they intended to deceive/ deprive.

    That will not work with the DWP. A genuine claimant has absolutely no reason not to comply with a compliance investigation. Those who comply find that things are sorted much more simply than those who try to be difficult.

  • oh i always COMPLY, no problem, but "they" (so far "they" include HMRC, VAT, DWP and few others) think they can bully folk into agreeing to anything, but I wont and dont cave in as they would like.
